The Crown Estate
19 January 2010
Dear Mr Caffrey,
Thank you for your recent Freedom of Information Request.
The Crown Estate is the property of the Sovereign, in right of the Crown.
It is not the personal property of the monarch, nor is it in any way the
property of the government. The net revenues from the estate, however,
have since 1760, been paid to HM Treasury. Nevertheless, the estate itself
remains vested in the Sovereign.
Since 1760 each successive monarch has assigned the management and
revenues of The Crown Estate to Parliament and Parliament has funded the
costs of government which before 1760 were funded by the monarch.
Parliament has also voted a civil list payment to cover the direct costs
of the monarchy.
I hope this answers your question, but if not, please get back to me. If
you think we have not handled this request correctly you may request an
internal review, and if still not satisfied, you have the right to make a
complaint to the Information Commissioner.

I think by "the Sovereign", they mean the Queen herself. Thus, the distinction you mention in the last paragraph should be between her and the Crown. The Crown is effectively a corporation sole separate from but wholly-owned by the Queen herself.
Property held "in right of the Crown" I think means something similar to "on behalf of the Crown" or "for the benefit of the Crown", so the revenues from the Crown Estate are applied for the benefit of the Crown rather than for the Queen's personal benefit.
I'm afraid I haven't managed to make this very clear. I wonder if WhatDoTheyKnow has any actual constitutional lawyers lurking. Halsbury's Laws of England has a few volumes that might be helpful if you can cope with legalese and have access to a copy.

Could it be explained how the Crown Estates can be simultaneously both the property of, and also not the property of the monarch?
The reply seems to imply that the "Sovereign" exists as a body quite separate from the incumbent head of state. This seems like a nonsense to me. If the Crown Estates belong to the sovereign, but not to the state, there is something clearly wrong with the arrangement.
