Thank you for your email received on the 11^th June 2009 in which you
requested information on how many occasions since July 2007 black wheelie
bins have been reported missing in Thornton Heath and on how many
occasions replacement bins have been issued.

Information Act 2000, and hope to respond to you promptly and within the
statutory 20 working days.

Dear Mr Fuller,
I am still waiting for a response to my FOI request of 12 June
2009. By law, you should have replied to my request by 9 July 2009.
You have not contacted me to say that you require extra time to
look at this request nor have you contacted me to clarify my
request.
I would be grateful if you could urgently consider my request - if
I do not hear from you by return, I will take my complaint directly
to the ICO.

I can confirm that the Council does not hold the information you request
as we do not record the information you have requested broken down by
wards.
If you are dissatisfied with the way the department has handled your
request under the Freedom of Information Act, you may ask for an internal

LBC is establishing a justified reputation for not responding to FOI requests as required by law.
At the same time, it is very harsh in the way it penalises the public if they chance to step outside it, for example when driving or parking.
The council is under an obligation to be helpful, as well as to respond promptly.
The council could easily provide details of how many across the borough have been reported.
They must have details of the location of each bin which had to be replaced because it went missing.
They can then find out which of these reports relate to Thornton Heath.
If that would cost more than the FOI limit, then they can reply with a Fees Notice.
There can be no excuse for taking 8 months to reply.
I suggest you make a complaint to the ICO via http://www.ico.gov.uk/complaints/freedom...
Simply state the facts, and complain that they did not respond within the relevant timescale, and then have now provided this wholly unsatisfactory response.
The length of time it took to respond the first time suggests that an Internal Review is unlikely to be effective.

Croydon Council needs to be brought to account for the cavalier way they fail to comply with the FOI law any time they choose - while clamping down hard on any member of the public who steps out of line.
