Dear Sir or Madam,
please could you break down the responses of the EHE families who
responded in writing to the Badman review questionnaire.
a simple count of how many said yes and how many said no in answer
to the questions noted in Annex C of the review with specific
attention to questions 2,4,5 and 6.
It would like to be able to discern from your response,
1) how many ehe families and children responded (not organisations)
2) how many of these responders said that they would welcome
compulsory registration and visits and thought that the current
legislation was not adequate for safeguarding nor a child's
possible potential to attain the 5 outcomes in ECM.
these figures should be readily available without too much hours of
work for the DCSF nor confidentiality issues.
thank you
Yours faithfully,

Department for Children, Schools and Families
10 August 2009
Dear Ms Berlow,
I am very sorry that you have not yet received a response to your request
(2009/0062830) received 13 July, under the Freedom of Information Act 2000
(the Act) seeking information in relation to the review of home
education.
The Department aims to respond to all requests under the Act within 20
working days and normally does so in at least 90% of cases. I am aware
however that a full response to your request should have been due today,
10 August. I am currently dealing with your request and will forward a
full response as soon as possible. Delays in responding to FOI requests
have been due to a number of factors including large volumes of
correspondence resulting from the review into home education. I would
however like to assure you that the Department takes its statutory
responsibilities under the Act very seriously and is always concerned
about delays in responding to individual requesters, recognising
the inconvenience and frustration which this may cause.
Outstanding correspondence is reviewed by officials on a weekly basis and
your correspondence is therefore under regular review. Once again please
accept my sincere apologies for the delay.
Yours sincerely,
Josephine Bell

Department for Children, Schools and Families
28 August 2009
Dear Ms Berlow,
I refer to your request for information, which was received on 13 July.
Before answering your request I should again like to apologise for the
delay in replying. This was partly because we had to commission some
additional analysis of the review responses to show the home education
responses that you requested. The Department is aware, however, that it
has missed the statutory deadline for reply and is in breach of its
obligations under the Act. We very much regret this and any inconvenience
this has caused you.

I have dealt with your request under the Freedom of Information Act 2000.
A breakdown of the responses to the public questionnaire is attached which
answers the questions you have raised.
You have also sent an email dated 14 August (reference 2009/0071874), in
response to my advice about the delay, in which you say that if the DCSF
cannot respond within the statutory deadline to FOI requests that the
consultation should also be delayed. Consultations are dealt with under
separate arrangements. The current consultation runs from 11 June 2009 to
19 October 2009 (18 weeks) which incorporates the Code of Practice
recommendation that longer timescales to the minimum 12 weeks should be
considered where these are feasible and sensible.
