Dear Haringey Borough Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Haringey Borough
Council's handling of my FOI request 'WGA L return'.

I have received a refusal noticed based on the suggestion that the
information is available to me by other means - the section 21
exemption. I do not accept that this is the case as the information
is not available from CLG in any form unless I were to put in a
separate FOI request. This suggests to me that section 21 is not
engaged. To take your argument to its logical conclusion, if two
public bodies hold information, they could each rely on section 21
to refuse the request.

You have also not, as required by FOI law, confirmed that you hold
the information I requested and therefore ask that you do so.

Your complaint that the Council breached the Freedom of Information Act

Thank you for your email received on 02 August 2010. 

I will now investigate your complaint. Our team is independent of the
Corporate Finance & Audit and Risk Management (Corporate Resources)
Department. I will talk to the people involved and obtain all of the
relevant information.

I aim to let you know the outcome of our investigation by 31 August
2010.  If I need longer, I will write to let you know the reason and when
you can expect a full reply.

Dear Sirkku,

Thanks for this. I'd just like to clarify my comment.

I am assuming that you hold the information I requested. If not
then clearly I will have to request it from CLG. However, if the
information is held, then you can only use the section 21 if the
information is reasonably accessible to me by other means. I do not
accept that this is the case as Ian Andrews is effectively
suggesting I make an FOI request that he implies will be refused.
This does not make the information accessible to me.

I also note that Mr Andrews suggests that Section 22 of the Act may
apply. As far as I am aware neither Treasury nor CLG have set our
their plans for publishing whole of government accounts other than
in the broadest term. It seems unlikely that the details in
individual returns will be part of any publication suggesting that
you should not rely on section 22 to withhold the information I
have requested.

Thank you for giving us an opportunity to review your complaint regarding
your Freedom of Information request, and make sure that we have done all
we can to put things right for you.

Your original request, received 19 July 2010 was for:

A copy of your Whole of Government Accounts (WGA) L return for 2008/09 as
supplied to the Department of Communities and Local Government.

We responded to your request on 29 July 2010 with the decision that the
information was exempt under Section 21 of the Act as is available from
the Department for Communities and Local Government (DCLG), and also that
some of it may be exempt under Section 22 (1) as it was likely to be
published.

You requested an internal review of the response on 2 August 2010 refuting
that the exemptions applied and also identifying that we had not confirmed
whether we held the information or not. I have now reviewed your original
request and the response you received.

I can confirm that we do hold the information and apologise that this was
not stated in the earlier response.

The previous response claimed that the information requested was available
from the DCLG and also that it would be published. This was incorrect and
therefore the exemptions used in this case were not applicable. Again I
apologise for this.

Please find attached a copy of Haringey's WGA L return for 2008/09, as
requested.

I hope that you are satisfied with my response to your Internal Review. If
you are dissatisfied, you may complain to the Information Commissioner,
who may be able to help you. Please note that if you wish to refer this
case to the Information Commissioner, they ask that you do so within two
