work providers in merseyside has there been this year 2009

YOUR REPLY TO FOI 2203-2206 WAS

Since January 2009 there have been 2 investigations by DWP into
Welfare to Work Providers in Merseyside and none in Southport. One
of the investigations found no evidence of fraud and the other
investigation has not yet concluded. No providers in Merseyside
have had to pay back funding to DWP since January 2009 as a result
of fraud.

SO YOU HAVE NOT provided THE INFORMATION FROM 28 NOVEMBER 2009 TO
JANUARY 2009 AS I HAVE ASKED FOR

Dear DWP Adelphi Freedom-of-Information-Request,please could you
tell me why when i was on new deal 13 weeks course i only did
11weeks( i had 1 week off sick) a4e phoned my adviser(alison lilly)
up at southport job center and told her i was finished at a4e ot
friday alison said no he has 1 more week left. a4e said to me they
would go over southport jcp head they phoned someone in liverpool
and i finished on the friday 1 week short of the 13 week
course?????????

Dear DWP Adelphi Freedom-of-Information-Request,YOU SAID I can
confirm that from 1st April 2006 until 4th January 2010, one
Welfare to Work Provider in Merseyside has had to pay back monies
to DWP as a consequence of fraud. The overpayment was £146 and was
the result of fraud by an individual employee of the company.

DWP HAVE ALSO SAID TO ME
It is not possible to identify all recoveries of overpayments as
these are typically offset against future payments due to the
provider, and are simply reflected as reduced net payments

A contradiction?????

How do DWP know the £146 was fraud if they don’t keep any detailed
records of such????????????

Dear Mr Rymer,

Thank you for your email of 22 January in response to the reply sent to
you about your request for information on Welfare to Work providers in
Merseyside. You said:

I am not aware of any allegations that I have made, what are the
allegations that I have made?

Section 21 of the Freedom of Information Act provides that a Public
Authority shall not be required to answer a request if the information
requested is already accessible by other means.

An 'allegation' is defined in the dictionary as a claim that someone has
done something illegal or wrong. Within the 38 requests to the
Department recently about A4E in Southport, you have made both specific
allegations, such as those concerning health and safety compliance, and
implicit ones through indicating that you have serious concerns about
their operations. You have also been involved with correspondence direct
with Jobcentre Plus in Merseyside which while it would be exempt from
release under section 40 of the Freedom of Information Act as being
personal information relating to you, is information already accessible
to you by other means.

As all this information is already available to you, being your
correspondence with the department expressing your views, we are under
no obligation to provide you with this information under the Freedom of
Information Act.

I should note that you have been informed that no record exists of all monies paid back and the reasons for it, but at no time were you informed that records were not held relating to this single matter.
