WIR29067: Freedom of Information request - Waste returns for Woodcote
Sawmill
Dear Mrs Hooper
Thank you for your request for information under the Freedom of
Information Act regarding waste returns documentation from Hazell and
Jefferies Ltd, for the Sawmill site, Woodcote Sawmill, Pot Kiln Lane,
Goring Heath, Reading, RG8 7SS.
I have looked into this matter with our Environmental Management team and
have to report that we do not have the data you have requested.
The Environmental Permitting Regulations 2007, Schedule 3, paragraph 13
provides exemptions under which there is no legal requirement to submit
waste returns. Woodcote sawmill was operated under such a paragraph 13
exemption. As exempt sites do not submit waste returns, we do not hold
the data requested.
The Environmental Information Regulations 2004 12(4) - states that a
public authority may refuse to disclose information to the extent that -
(a) it does not hold that information when an applicant's request is
received;
Therefore in this instance, as we do not hold the information you have
asked for, we have no option but to refuse your request.
If you are not satisfied with our decision not to supply the requested
information you can contact us to ask for our decision to be reviewed. If
you are still not satisfied following this, you can then make an appeal to
the Information Commissioner, who is the statutory regulator for Freedom
of Information.
I'm sorry that we are unable to help with your request, should you have
any other queries please don't hesitate to contact us.
Best regards,
Nicola
