Dear Sir or Madam,

Ref. Planning application 2007-6181

As all know, the PCT lodged notice of Appeal against the rejection
of their 'plan'to build on greenbelt Arrowe Country Park land, at
'The Warrens'. A first date for Appeal, was set up for Oct. 08.
This was then postponed. A second date for the said 'Appeal' was
arranged for a 4 day enquiry from 10th Feb., last month.4 days
before this was due to take place, residents were notified that the
'Appeal' had been withdrawn. Considerable time and expense had been
spent on preparation for this 'Appeal'. No reason was given for the
withdrawal. Members of the Planning Cttee. had had to engage with
Counsel, in preparation for this important event.Considerable costs
would have been incurred.

QUESTIONS a) What is the explanation for reason for withdrawal of
'Appeal', made by applicants?
b) How much in costs was incurred by the PCT's decision to embark
on 'Appeal' proceedings? Costs to 'Council'...
c) As the applicants requested the Appeal, and caused Legal and
other professional costs to be incurred, to 'the Council'..... have
they now been billed for those costs?......Have they now settled
that account?
d) If not, what action is being taken by the new Dept. of Law, HR
and Assett management, to recover the costs of the aborted Appeal?

Dear Sir or Madam,
Please send me the information requested re. the costs involved in
preparation for cancelled 'Warrens Appeal', and all other info.
related as written in my FOI request...response which should have
been by 7th April...now well overdue..This constitutes a COMPLAINT,
in keeping with guidance in, 'Part VI of the Secretary of State's
Section 45 Code of Practice' - relevant Code on FOIinternal
appeals...... I thus again request...a) the information asked
for...b) an internal review according to guidance quoted.
The Council is not conforming and is at present, not observing the
Law. PLEASE CONSIDER THIS MY OFFICIAL COMPLAINT. INFORMATION
REQUESTED IMMEDIATELY PLEASE.

requested re. Appeal cancellation/Warrens/ costs, within the time
scale set by Secretary of State, and request for IMMEDIATE internal
