Dear Sir or Madam,

Please provide the following data, broken down for each year:

(1) In the last 5 years, how many warrants for arrest have been
issued for an individual who has broken their probation licence
conditions?

(2) Out of this figure, how many were considered high priority,
and/or considered to pose a risk of harm to others?

(3) Out of the total number of warrants issued per year, as stated
in answer to (1), how many of those individuals have been
re-arrested?

(4) Out of the warrants consider high priority, as stated in the
answer to (2), how many of those individuals have been re-arrested?

(5) Out of the total number of warrants issued, as stated in the
answer to (1), how many of those individuals have re-offended while
a warrant for their arrest was active?

(6) Out of the total number of warrants issued, as stated in the
answer to (2), how many of those individuals have re-offended while
a warrant for their arrest was active?

(7) Referring to the individuals stated in answer in question (5),
what crimes have they committed while a warrant for their arrest
was active?

(8) Referring to the individuals stated in answer in question (6),
what crimes have they committed while a warrant for their arrest
was active?

(9) Please provide the following information about any individual
who is the subject of a warrant for arrest for breaking their
probation licence conditions, but who has not as yet been
re-arrested:

* names, ages and last offence for which they received a custodial
sentence.

Dear Mr Plough

FREEDOM OF INFORMATION ACT 2000

Thank you for your request for information, received 09 July
2009 concerning warrants issued.

Your request is being considered and you will receive a response within
the statutory timescale of 20 working days, as defined by the Act, subject
to the application of any statutory exemptions. Where consideration is
being given to the application of any exemptions the 20 working day
timescale may be extended under the terms of the Act to a period
considered reasonable depending on the nature and circumstances of your
request. In such cases you will be notified and, where possible, a revised
time-scale will be indicated. In all cases we shall attempt to deal with
your request at the earliest opportunity.

There may be a fee payable for the retrieval, collation and provision of
the information requested, where the request exceeds the statutory limit.
In such cases you will be informed in writing and the 20 working day
timescale will be suspended until we receive payment from you or your
request is modified and /or reduced. If you chose not to make full payment
or modify your request then the request will remain unanswered.

Your request may require either full or partial transfer to another public
authority. You will be informed if your request is transferred.

FREEDOM OF INFORMATION ACT 2000

Your request for information, received 9 July 2009, concerning probation,
has now been considered.

Warrants are issued on a daily basis for a variety of reasons with breach
of probation being only one of many circumstances narrated on the face of
apprehension warrants. In order to isolate the relevant warrants it would
be necessary to conduct a manual search of all warrants administered for
the five year period requested.

Please note that researching each individual warrant would exceed the
appropriate limit (FOIA, s.12 (1)). This means that the cost of providing
you with the information is above the amount to which we are legally
required to respond, i.e. the cost of locating and retrieving the
information exceeds the "appropriate level" as stated in the Freedom of
Information (Fees and Appropriate Limit) Regulations 2004. For West
Midlands Police, the appropriate limit is set at £450, as prescribed by
the Freedom of Information and Data Protection (Appropriate Limit and
Fees) Regulations 2004, S.I. 3244.

In accordance with the Freedom of Information Act 2000, this letter acts
as a refusal notice.

However under Section 16 (Duty to Assist) of the Freedom of Information
Act we have been advised that the National Offender Management Unit within
the Ministry of Justice do hold this information in an easily retrievable
format. We suggest that you submit your request to them at the following

Your attention is drawn to your right to request a re-examination of your
case under West Midlands Police review procedure (attached). Please note
that such an appeal must be received within six months of the date of this
correspondence.
