War Pensions procedures, obstacles & uneven playing field

Dear Ministry of Defence,

We seek a full and transparent disclosures of veterans procedures
from initial application to the highest level of the Tribunal Court
hearings, the representations, by who. If there is barristers
provided for veterans to present the case at the hearings where the
MOD employs barristers at taxpayers expense and those taxpayers may
by default be the veteran making the application. If it true that
veterans assessed at less that 20% disabled receive no war pension

Please disclose all grants for public funding to not-for-profit
Royal British Legion who represent veterans and lower level and
upper tribunal Hearings. That includes funding from the Legal
Services Organisation legal aid fund.

We are having resistance for the Royal British Legion and if they
receive government funding please provide the executive structure
as part of this request.

With our troops dying in Afghanistan, losing life and limb and
suffering other long term conditions the people of this country
will not forgive this government of the senior servants if you
attempt to hide behind various sections of the FOI act.

If there is anything we have not asked but is related and we should
be aware please ensure that information is disclosed.

Section 8(1) of the FOI Act sets out the requirements of a valid request
for information and says that a request must, amongst other things,
"state the name of the applicant and an address for correspondence".

Operation Veteran/Gate
The Scandal of 21st century Britain and the abuse of our brave war
hero veterans: - We are appalled that veterans seeking a war
pension are forced into the court system have less rights that
serious criminals, murders, rapists and Islamic Terrorists. Faced
against a MOD barrister paid for by the State the veterans have
little representation except unqualified members of their
Regimental Associations or the Royal British Legion. We understand
these organisations cherry pick whom they will represent. As many
of these veterans seeking a war pension suffer mental scarring,
psychological damage or alcoholism are difficult individuals to
deal with; many are kicked into touch and left to battle alone. We
seek to remove the many obstacles that governments for many decades
have erected. We will force government to provide a qualified
barrister paid for by the State thus providing a level playing
field at the Tribunal Court Hearings or we will seek to indict
those responsible in the International Criminal Court for Crimes
against humanity in violation of the Statue of Rome. The ICC does
not prosecute governments or departments but individuals. That
removes the protection of government provided lawyers. We are
interested in hearing veterans' stories and their fight to obtain a

Some of the obstacles are the MoD cannot or will not look for or find hospital records, in my case these were records from the Military mental hospital at Netley the Navy, Norcross or Whitehall could not locate them. All the time they were in the archives of the MoD at Shrewburyness.
When they are found they are not read by the Doctor's employed by Norcross.
They do not pass on these documents to tribunal's when they are found and it is only when the individual gets to the tribunal that they find out all the records are not presented.
Also the Doctors (or M.A.s) as Norcross call them do not have the medical back ground in the field they are assessing i:e - a Gynaecologist is one of the Doctors assessing claims for P.T.S.D. which is a mental health issue. I could go on they claim my mental health issue arose in 1976 and I was still used in experiments at Porton Down in 1977 but I am barred from claiming that at any tribunal as there is no medical link to ill health or mental breakdowns.
