Dear Mr Tallantire

Thank you for your query, which was passed to me to respond to and for
which you received an acknowledgement from the NBU. May I offer my
sincere apologies for the delay in responding to your request, this was
entirely due to an administrative oversight for which I can, again, only
offer my apologies.

You asked for:

data on complaints made to OFSTED when schools have refused to provide SEF
reports to interested parties.

The school SEF (Self Evaluation Form) is a document that schools create
on-line and which the school owns. Completion of a SEF is not mandatory,
although almost all schools choose to do so. Most schools review their
SEF on a regular basis; schools may save any amendments and can choose
when they wish to submit them to Ofsted. Most schools are able to provide
inspectors with an up to date SEF when they are notified of inspection.
This enables the inspectors to use the SEF alongside other information in
preparation for the inspection. There is no statutory duty on a school to
submit a SEF and an inspection will continue if a school has not completed
one.

Schools own the information that they provide to Ofsted in the SEF and it
is given in confidence. It is the school's decision whether it chooses to
release any or all of the information it contains to interested parties.
If, for example, a school refused a request by a parent for a copy of the
SEF and they complained to Ofsted about this refusal, it would not
constitute a qualifying complaint under Ofsted's powers to consider
complaints about schools as defined in section 11 of the Education Act
2005, as amended. Further information about Ofsted's powers to
investigate complaints about schools is on the Ofsted website [1]HERE. To
comply with data handling requirements, non-qualifying complaints are
retained only for three months and Ofsted does not hold specific
information about the number of complaints relating to the release of
SEFs.

I am unable, therefore, to provide you with the information that you have
requested.
