I am writing in response to your request for information under the terms
of the Freedom of Information Act 2000, Ref No FOI/09/083
Please find attached a dated copy of the checklist used by the Planning
Support team in order to ascertain that the correct procedure in dealing
with the administration planning application 08/00553/FUL.
It refers to the "Validation Checklist", which can be found at
[1]http://www.chorley.gov.uk/index.aspx?art.... This is to guide
applicants and the Planning Support team. The checklist attached states
that the application number 08/00553/FUL was valid in respect of the
Validation Checklist. Chorley Council does not hold a dated copy of the
Validation Checklist with regard to planning application 08/00553/FUL.
However, the Support checklist indicates that the Validation Checklist was
followed.
As the Validation Checklist document can be found on the Chorley Council
website, I therefore refuse your request for this information on the
grounds that the information is reasonably accessible by other means,
under Section 21 of the Freedom of Information Act 2000. This is an
absolute exemption; therefore the Public Interest test has not been
implemented.
I hope the information provided here answers your enquiry. If however,
you are unhappy with the outcome, or the way in which Chorley Council has
handled your request, you may wish to make an appeal. This can be done in
writing to the Freedom of Information Officer, Chorley Council, Civic

Thank you for your reply, we already have the support team
checklist.
If there is no dated copy of a completed validation checklist, how
does the support team know what part or parts of the list have been
complied with.
Does the Councils Constitution require true and accurate records?
If you are checking something off, you first need to know whether
all procedures have been followed and adhered to.

The Planning Support team are instructed to check basic points on receipt
of an application e.g. Has a land ownership certificate been provided, is
there a location plan to a scale of 1:1250 or 1:2500, does the location
plan show the application site edged red, etc. This guidance is contained
within the Validation Checklist that is on our website. No further
checklist is completed.
Should you require any further detail on this matter, could you please
contact the Business Support team directly on 01257 515346, as your last
question is not a request for recorded information, but a question on
procedure, and as such falls outside of the scope of the FOI Act 2000.
