Dear Sir or Madam,
I am writing to you to request information under the Freedom of
Information Act 2000. In order to assist you with this request, I
am outlining my query as specifically as possible.
Please tell me the number of calls and crimes concerning use of
motorcycles and mini-motos on cycleways in the North Worle area
bounded by Wansborough Road, Queensway, Ebdon Road, Dunkite Lane,
Castle Batch and Becket Road by month in the 18 months to date.
I am interested in any information held by the Avon and Somerset
Constabulary regarding my request. I understand that I do not have
to specify particular files or documents. I would be grateful if
you could confirm in writing that you have received this request.

Please tell me the number of calls and crimes concerning use of
motorcycles and mini-motos on cycleways in the North Worle area bounded by
Wansborough Road, Queensway, Ebdon Road, Dunkite Lane, Castle Batch and
Becket Road by month in the 18 months to date.
This request will be dealt with under the terms of the Freedom of
Information Act 2000.
Your request will now be considered and you will receive a response within
the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt or containing a reference to a third
party. In some circumstances Avon and Somerset Constabulary may be unable
to achieve this deadline. If this is likely you will be informed and given
a revised time-scale at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make a payment then your request will
remain unanswered.
Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.

I am writing to persue my request for the number of calls and
crimes concerning use of motorcycles and mini-motos on cycleways in
the North Worle area bounded
by Wansborough Road, Queensway, Ebdon Road, Dunkite Lane, Castle
Batch and Becket Road by month in the 18 months to 7 July. By law,
the response had to be prompt but no later than 6 August 2009. I
have received no response other than an acknowledgement of the
request at this time.

In relation to the number of crimes:
Where exemptions are relied upon, Section 17 of the Freedom of Information
Act 2000 requires Avon and Somerset Constabulary, when refusing to provide
such information (because the information is exempt) to provide you the
applicant with a notice which: (a) states that fact, (b) specifies the
exemption in question and (c) states (if that would not otherwise be
apparent) why the exemption applies.
There is no specific crime that relates to the information requested.
Therefore every crime/incident that occurred within the specified area
would need to be viewed in order to ascertain whether within the
circumstances of the offence any details relating to motor cycles or
mini-motors was recorded, for example a public order offence. The cost of
providing you with the information is above the amount to which we are
legally required to respond i.e. the cost of locating and retrieving the
information exceeds the “appropriate level” as stated in the Freedom
of Information (Fees and Appropriate Limit) Regulations 2004. It is
estimated that it would cost at least £450 to comply with your request.
In accordance with the Act, this letter represents a Refusal Notice for
this part of your request.
Under section 16 (duty to assist), please find below a link to the Avon

that occurred within the North Worle Beat, which may be of assistance to
