Dear Sir or Madam,
On the 4th of December 2008 the European Court of Human Rights has
delivered at a public hearing its Grand Chamber judgement in the
case of S. and Marper v. the United Kingdom (application
nos.30562/04 and 30566/04).
The Court held unanimously that:
ยท "there had been a violation of Article 8 (right to respect for
private and family life) of the European Convention on Human
Rights;" with regards to the UK goverment holding DNA and
fingerprints on innocent people.
As the UK goverment has lost its case and was found to be
unlawfully holding DNA and fingerprint details of innocent people i
wish to know the following
As of the 4th of December 2008
1: How many DNA and fingerprint samples of innocent people have
deleted ?
2: How many innocent people requested their DNA and fingerprint
samples be deleted?
3: If no DNA and fingerprint samples have been deleted i wish to
know the reasons WHY as the UK Goverment have been found to be in
breach of innocent peoples human rights and this would be
considered a crime in itself.
4: As there is no right of appeal from a final decision made by the
Grand Chamber when will your police force be routinely be deleting
records of innocent people ?

Thank you for your request for information dated 31 January 2009 and
received by the Freedom of Information Unit on 2 February 2009, concerning
DNA and fingerprint samples. This request will be dealt with under the
terms of the Freedom of Information Act 2000.
Your request will now be considered and we aim to provide a response
within the statutory timescale of 20 working days i.e. 2 March 2009 as
defined by the Act, subject to the information not being exempt or
containing a reference to a third party. In some circumstances Dyfed Powys
Police may be unable to achieve this deadline. If this is likely you will
be informed and given a revised time-scale at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of the
information you request. If this is the case you will be informed and the 20
working day timescale will be suspended until we receive payment from you. If
you choose not to make a payment then your request will remain unanswered.
Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.

the purposes of clarity can you confirm the interpretation of "Innocent"
in respect of your request as being:
An individual that has been arrested, his/her DNA taken but that
individual not convicted and also an individual that has been arrested
and convicted but their conviction subsequently overturned.
If this is not the correct interpretation can you please provide your
interpretation? Once again, sorry for the delay Your request will be

thank you for you mail message. the term innocent for the propose
of this request is someone who has never been convicted of a
criminal offence, but you also raise another point ,when an
individual that has been arrested and convicted but their
conviction subsequently overturned are they not also innocent ?.

January 2009 which was received in the FOI Unit at Dyfed-Powys Police on
the 2^nd February 2009 regarding DNA and Fingerprint samples.
Your request has now been considered and firstly I am obliged under S (1)
(a) of The Freedom of Information Act 2000 to tell you whether the
information is held by the force.
I can confirm that the information sought in respect of questions 1 and 2
is held and provided in the attached response. However as outlined in the
response I regret to inform you that there is no information held by
Dyfed-Powys Police in respect of questions 3 and 4.
I would like to take this opportunity to thank you for your interest in
Dyfed Powys Police. I would also like to apologise for the delay in
responding which has been due to the volume of requests received and the
workload associated with the requests.
