Dear Sir or Madam,
Can you please supply all inspection records/findings as regards
your activities at the United Utilities sewage plant at Fleetwood
in Lancashire? Can you also please supply all internal documents as
regards analysis of your findings and, for instance, any future
plans to regulate the foul odours that regularly emanate from that
plant? Can you also provide all records as to warnings or sanctions
applied against United Utilities as regards the continuing foul
odours that have emanated from that plant for over 10 years?
Can you also provide documentation as to your responsibilities in
the areas as outlined above re: anti social and foul odours
emanating from the plant that foul the natural environment in the
locality that has to suffer such odours? Can you also please supply
all records of the numbers of complainanats that have raised this
issue directly at the Environment Agency, Wyre Borough Council and
United utilities itself?

Dear Ms Cottam,
I have made this request under the Freedom of Information Act 2000.
Please respond within the twenty day allowable legal limit. For the
avoidance of any doubt I have also provided some basic information
as regards the Act below.
A Public authority may charge a fee to supply information where the
cost of doing so exceeds an appropriate limit as set down in the
regulations – appropriate limit is set between £450 and £600
depending on the type of Public Authority.
Personnel time is to be estimated at £25 per hour and for the
purposes of calculating the appropriate limit, account can be taken
of such activities as determining whether it has the information,
locating it, extracting it etc.
However, the Public Authority will still be obliged to communicate
to an applicant that it holds such information. It must give notice
to an applicant with
reasons if a refusal is to be made. An applicant can ask for
information to be supplied in:
- permanent form
- summary form
- or for permission to inspect records containing the information.
I hope that this clarifies the position and expect my request to be
answered in a timely and lawful manner.

Thank you for your further e-mail of the 2 September 2008.
After looking further at your request, we can provide the information for
free under the Freedom of Information Act 2000, as it does not exceed
our appropriate limit of £450.
We can supply the information you have requested, or as an alternative you
can come down to our area office at Lutra House, Bamber Bridge, Preston at
an arranged time to go through the documents with the Environment Officer
for the site. The Environment Officer will be able to interpret what all
the information means and answer any questions you may have.

arrangements.

Thank you for your enquiry. We have the following information for you.
* The Environment Agency have only been regulating the treatment works
since November 2008.
* We have received 71 complaints from members of the public since we
started regulating the site. We are unable to comment on complaints
received by Wyre Borough Council and United Utilities.
* We have not issued any warnings to United Utilities in relation to
foul odours.
* Please find attached a briefing note for Fleetwood Area Forum from
August 2008, and all the compliance reports for the site.
