Unfair terms in EULAs

Peter Collingbourne made this Freedom of Information request to National Consumer Council

The request was partially successful.

From: Peter Collingbourne

22 May 2009

Dear Sir or Madam,

According to this BBC news article:

http://news.bbc.co.uk/1/hi/business/7252...

in February last year, the NCC (now Consumer Focus) asked the OFT
to launch an investigation into potentially unfair terms in EULAs.
I presume this means that the NCC made a complaint under section 10
of the Unfair Terms in Consumer Contracts Regulations 1999. I would
like to request:

1. a copy of the NCC's complaint letter

2. a copy of any correspondence between the OFT and the NCC in
relation
to the complaint

3. if the complaint has been decided, a copy of the OFT's letter
informing the NCC of its decision as to whether the terms are
potentially unfair, and the statement of reasons it is required to
produce under section 10(2) of the UTCCRs.

Yours faithfully,

Peter Collingbourne

Richard Taylor left an annotation (15 July 2009)

WhatDoTheyKnow received a request to remove a signature from one of the attached documents. (See http://www.whatdotheyknow.com/help/about... for guidance on our policies)

We asked for a new response to be made, with the signature omitted, and agreed if that was done to delete the original.

The new response contained only the one document, and instead of being a copy of document itself as had originally been supplied, the new reply contained only the text. In order to minimise the amount of information lost I have removed only the page of the PDF which contained the signature from the original response. The only text on this page was : "Yours sincerely Ian Levy Consumer Protection Group" and the signature. The redacted (one page only rather than the original two pages is linked from the above request and is available at http://www.whatdotheyknow.com/request/12...)

My aim here has been to enact the redaction in the most transparent manner possible while retaining as much information as I could.
