Dear Hounslow Borough Council,

Under the Freedom of Information Act 2000 I seek the following
information, for each of the five years to March 2009 (or December
2008 if more convenient) inclusive:

1. The number of unauthorised places of worship that were
identified by the council's planning department.

2. The name and location of each of the unauthorised places of
worship identified, together with your case reference number.

3. The outcome in each case: whether each was subsequently
regularised; or shut; whether the case was referred to another
department, authority or agency; or whichever other outcome.

Dear Mr Lluva

I am writing with regard to the information you requested under the
Freedom of Information Act and received in this department on the 17th
December 09 relating to unauthorised places of worship

We are treating this request under the Environmental Information
Regulations 2004 as it is information held on a planning enforcement file.
A planning enforcement action is a measure which would affect or be likely
to affect the state of the elements of the environment, specifically land.
As such, the information fits within the definition of environmental
information under Regulation 2(1)(c)1 in the EIR.

Information requested with answer under each in turn.

1. The number of unauthorised places of worship that were identified by
the council's planning department.

There are 4 such cases identified from 2005 to date.

2. The name and location of each of the unauthorised places of worship
identified, together with your case reference number.

Three of the cases were closed as no enforcement action to be taken. In
these cases, we will not release the names and locations as this would
breach Data Protection principles and as such we apply Regulation 13 in
refusing your request. Regulation 13 says "To the extent that the
information requested includes personal data of which the applicant is not
the data subject, and as respects which either the first or second
condition of Regulation 13 is satisfied, a public authority shall not
disclose the personal data. The first condition states that disclosure
of the information to a member of the public otherwise than under these
regulations would contravene any of the data proction principles. The
public interest test having been applied, the reason for non disclosure
outweighs the reason to disclose.

The remaining case was subject to a planning application, and enforcement
action was not taken. As a planning file is in the public domain, details
are published on our website [1]www.hounslow.gov.uk which can be accessed
using the planning search facility. For the purposes you require the
planning reference is 00855/A/P16.

3. The outcome in each case: whether each was subsequently regularised; or
shut; whether the case was referred to another department, authority or
agency; or whichever other outcome.

Answers in 2 above.
