Transgender prisoners and PSO3300

Dear HM Prison Service,

a) Please could you provide information on the status of PSO 3300, "Guidelines on the Management, Treatment and Care of Prisoners who have or have had Gender Dysphoria" or any other draft or current PSOs or PSIs or similar guidelines on this topic. The last public information available indicates that this PSO was still in draft status, if this is still the case please can you state when you expect it to come into force.

b) Please provide a copy of draft PSO 3300 or any other related draft or current PSOs, PSIs or similar guidelines.

c) Could you also provide any and all information, including minutes of meetings and emails, related to the effects of the gender reassignment provisions of the Equality Act 2010 on draft or current PSOs/PSIs or on current Prison Service practice in general.

If item (c) would take this request beyond the maximum time/resources for an FoI request, please provide just (a) and (b).

SUBJECT: Freedom of Information Request

asked for information about Gender Dysphoria and prisoners, and
PSO3300 under the Freedom of Information Act 2000 (FOIA) from the
Ministry of Justice (MoJ).

You will receive a response from us by November 29, 2010. Your request
has been passed to the appropriate business unit within the MoJ, and
they will write to you with their decision by this date.

The FOIA does provide a number of exemptions. A qualified exemption
requires that before relying on it we must consider the public interest
test. If the information you have requested is covered by a qualified
exemption(s) under FOIA, the Department is allowed to take longer than
20 working days to respond. This is because in such circumstances we are
required to consider the public interest issues when deciding whether or
not to disclose the information requested.
