I refer to your recent request for information as set out below:
I would like information on police responses in regard to the
The Wildlife and Countryside Act 1981 which have occurred in the
Ellesmere Port Neston area in the last two years
Can we ask if you could clarify your request because as it stands it is far
to wide for us to supply a meaningful response within the FOI cost
threshold.
The Wildlife and Countryside Act 1981 is in four main parts with 74 main
sections and 17 schedules. Topics covered include Wildlife, Nature
Conservation, Countryside and National Parks & Public Rights of Way. There
are several statutory bodies and other organisations that have powers under
the Act with whom the police will inter act or who may take up
investigation and proceedings, local authorities, Natural England and the
RSPCA spring immediately to mind.
It would be helpful therefore if you would define what areas you wish us to
look at or perhaps which specific offences you would wish us to research.
Until such time as your are able to respond you request will remain on
hold.

Dear Cheshire Police Authority,
I am interested in police responses in regard to birds protected
under Schedules 1 and 9 of the Wildlife and Countryside Act 1981
The schedules mentioned refer to:
Schedule 1 Birds protected
Schedule 9 Animals & Plants - Introduction of new species etc
In accordance with section 1(1) (b) of the Act our response is provided
below;
There were six related incidents reported to Cheshire Police during the
past two years for Ellesmere Port and Neston areas as follows:
1. 22nd April, 2008 at Ellesmere Port. Youths firing stones at ducks from
catapults. Advice given by call management. No police attendance required.
2. 16th December 2008 at Ellesmere Port. Two men reported for summons for
keeping a wild Goshawk without a registration certificate.
3. 14th May, 2009 at Ellesmere Port. Report of a bush being cut down with a
birds nest in it. Advice given by call management. No police attendance
required.
4. 27th May, 2009 at, Neston. Maintenance workers disturbing nesting birds.
Prompt response.
5. 28th August, 2009 at Ellesmere Port. Report of air gun pellet tins found
close to nesting Sparrowhawks on the allotments. Deferred to NPT for
information and attention.
6. 23rd October, 2010 at Parkgate Complaint of potential barn owl
disturbance. Matter resolved with developer. No disturbance.
If I can be of any further assistance in this matter, please do not
