Dear Sir or Madam,

Please disclose the completed TFR financial return spreadsheets
provided by each NHS Trust for the last three financial years
(2007-08, 2006-07, 2005-06).

Pursuant to FOIA section 11(1) I express the preference for you to
provide this information electronically, by email, in the original
(xls) format, or alternatively in a non-proprietary format commonly
used for electronic data exchange (such as csv). However, PDF files
are not acceptable.

Dear Sir or Madam,

I wish to withdraw the FOI request made earlier today, 11 January
2008 and substitute it with the following:

According to the "NHS Trust End of Year Letter 2007-08" [1], data
collected from TRU (formerly TAC) and TFR spreadsheets is imported
into a database held by DH. This is evidenced by the following
statement made within the letter: "If this [saving in the correct
format] is not done Quarry House may not be able to open these
files or import them to the database."

I require disclosure, in a non-proprietary electronic format
customarily used for electronic data exchange other than PDF (such
as CSV) of a complete database export from said database of the
database tables containing data collected from TRU (formerly TAC)
and TFR spreadsheets submitted in the financial years 2007-08,
2006-07, 2005-06.

Dear Mr Collingbourne,

Thank you for your email of 11 January requesting, under the Freedom of
Information Act, data collected from TRU and TFR spreadsheets. Your email
has been passed to me for reply.

I can confirm that the Department holds the information you have
requested. However, the data is being held on a CD due to the size of the
files. I would be grateful if you could respond by 28 January with your
mailing address so that I may forward you the CD by post.

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Department of
Health's handling of my FOI request 'TFR Spreadsheets'.

I specifically required that you disclose the information in a
non-proprietary format. However the CD I have received contains an
encrypted file, "DE381002.exe". In order to execute this file and
decrypt the contents, it would be necessary to purchase a piece of
proprietary software known as Microsoft Windows. Furthermore, your
letter indicates that Excel spreadsheets are included within the
encrypted file. In order to view these files, it would be necessary
to purchase a piece of proprietary software known as Microsoft
Excel. In summary, your disclosure fails to meet the requirements
of FOIA section 11(1)(a) as you have failed to give effect to the
preferred form of disclosure.

I would furthermore argue that your response does not meet the
requirements of FOIA section 1(1)(b). This section requires that
the information be "communicated" to myself, but because I am
unable to decrypt and therefore access the information requested,
the information has not been "communicated" to me. I do not intend
to contact the individuals you have mentioned in your response
letter in order to obtain the password, as it is not a requirement
for me to do anything other than make a single request for
information to you (see FOIA section 1(1)).

Having now had the opportunity to examine the Department's
disclosure in detail, I note that a small amount of information
appears to be missing from the disclosure, namely the content of
any "freetext" fields. Please ensure that this information is
supplied by return as soon as possible. I would also like the
ongoing internal review to consider the fact that I was not
initially provided with this information.
