I would like to request access to a study prepared by Lt Gen Chris Brown
and commissioned by the Ministry of Defence concerning the invasion of
Iraq.
I can confirm that the Ministry of Defence holds the requested
information. However, release of this information is to be withheld under
Section 36 of the FOI Act.
If you are not satisfied with this response or you wish to complain about
any aspect of the handling of your request, then you should contact me in
the first instance. If informal resolution is not possible and you are
still dissatisfied then you may apply for an independent internal review

thank you for your mail.
I note that you confirm that the Ministry holds the information
requested and that you rely on Section 36 of the Freedom of
Information Act 2000 in refusing access.
As you will know, of course, section 36 encompasses different
reasons for refusal of access and is therefore quite broad. In
order to understand your refusal better, could you inform whether
you rely on subsection (2) (a) (i), subsection (2) (b) (i),
subsection (2) (b) (ii) or subsection (2) (c) or any other
subsection of section 36?
Furthermore, Section 36 requires the verdict of a qualified person
on the request. Subsection (5) (a) states that for the purposes of
information held by central government departments, the qualified
person is a Minister of the Crown. Could you indicate to me who
made the decision in this case that Section 36 is engaged?

response, I will decide whether I shall request Internal Review or
not.

It is proving difficult to conduct a full internal review as the
substantive response to your request for information has not yet been
issued to you.
I should explain that the internal review process is aimed primarily at
reviewing MOD's substantive response to a request for information to
assess its compliance with the Act or EIR. In this situation the most
productive solution is to investigate the reasons why you have not yet
received a substantive response and to ensure that you are provided with
one as soon as possible. We have therefore asked the responding branch to
provide you with an update by Fri 17 September 2010 and we will also
continue to ensure that you are regularly informed of progress.

I find that the initial response to you on 21 June 2010 was confusing. You
should have been informed that your request was being considered under the
relevant qualified exemption (section 36) and that additional time was
needed to conduct a Public Interest Test (PIT) in order to determine
whether the balance of the PIT lay in release. In addition, I am advised
that other exemptions may also apply to the information requested such as
section 26 (defence) and section 27 (international relations) which are
also subject to public interest testing.
I am sorry that you have not been previously advised of the full
situation. Therefore, I can inform you that a decision has not yet been
made about your request and you have therefore not received a substantive
response from MOD so far. I must apologise that the initial response gave
the impression that a decision had already been made about your request. I
have, therefore, asked the relevant MOD Business Unit to provide you with
an update by Friday 17 September 2010.
As I mentioned, once you have received a substantive response, we will
automaticaly review your request in full, if still required.

Sometimes a bit of a push seems to help. Here's what I got after complaining directly to the Permanent Under-Secretary:
"Mr Bimmler,
Thank you for your email of 28 January concerning your complaint about
our handling of your Freedom of Information (FOI) Request dated 27 May
2010. Mrs Brennan has asked me to respond.
The Department takes its responsibilities for complying with FOI very
seriously. On this occasion it is clear that our performance has fallen
short of meeting the standard required under the FOI Act, for which I
apologise.
As a result of the Information Commissioner bringing this matter to our
attention (their reference FS50365907) work has already been set in
train as a matter of urgency to ensure that the Department's response to
your request is properly reconsidered and that you are provided with a
formal response in accordance with our obligations under the FOI Act.
The Permanent Secretary has asked officials to ensure that you receive a
reply by 18 February.

In that email he stated that we would not be in a position to provide you with a full response until Friday 4 March. However, the issue is still being considered at senior level. As a result I am afraid that we will not be in a position to provide you with a full response at the moment. We hope to be able to provide a response within seven days. I know that this is a further delay but I would like to assure you that the issue is receiving appropriate consideration at senior level and as my predecessor stated the material could be sensitive to national security.
