Dear Mr. Woods,
Thank you for your application for information concerning the number of
stop & searches carried out on the 27th May 2009. This will be dealt with
under the terms of the Freedom of Information Act 2000.
Your request will now be considered and you will receive a response within
the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt nor containing a reference to a third
party. In the event that we are not able to achieve this deadline you will
be informed at the earliest opportunity and given a revised time-scale.
There may be a fee payable for the retrieval, collation and provision of
the information you have requested. If this is the case you will be
informed and the 20 working day timescale will be suspended until we
receive payment from you.
Some requests may also require either full or partial transfer to another
public authority in order to answer your query in the fullest possible way.
Again, you will be informed if this is the case.

Dear Sir or Madam,
You stated in your response "There were a total of 40 Stop &
Searches carried out in Huyton on this date." and "No searches were
carried out under the authority of Section 60 in Huyton on this
date."
I have two stop and search records from two people who were stopped
in Huyton on this day. Both records state that they were stopped
"under section 60 powers".
I know of others in Huyton who were stopped under section 60 powers
on this date.
Therefore, the information you have supplied seems incorrect, can
you explain this?

My understanding is that the issues you have raised are that Merseyside
Police have failed to disclose information held in respect of Section 60
stops. I will forward your concern to an independent person for review, who
reply to you directly.
The review will be conducted in accordance with the Merseyside Police
review procedure and every effort will be made to have a response to you by
the 29/10/09 (as advocated by the ICO). If it becomes clear that the review

carried out in the Huyton area.

searched under legislation that was not in place at the time of
