Dear Mr Thomas,
Thank you for your freedom of Information request of 6 April, apologies
for the delay in responding which was due to the Officer handling the
request being on sick leave.
In your request you asked for:
"all correspondence between the Council and all interested bodies which
discussed how best to deal with the objections to the rebuilding of
Stockwell Park High School. Specifically in relation to objections to
the siting of the Sports and Waste facilities on properties backing on
to Stockwell Park Road."
In response to your request please find below and attached information
relevant to your request.
We have checked the case file and can confirm that there is no such
correspondence. It is not standard procedure to write to consultees,
objectors etc to discuss how we intend to "deal" with objections, if for
no other reason such correspondence would be highly time consuming,
particularly on schemes such as this which resulted in over 2200
consultation letters being issued to local occupiers and approximately
100 objections being received (on various issues).
When objections are received, planning officers consider the
representations against the Council's adopted planning policies (the
Unitary Development Plan) as a fundamental part of their assessment of
the merits of the application. The objections are then specifically
addressed in the subsequent report to (in this instance) the Planning
Applications Committee.
In this case, as is standard procedure, the report specifically lists
the objections and addresses how they cannot be sustained or can be
mitigated against. When, as here, it is resolved to grant planning
permission conditions are imposed which mitigate the potential harm that
the development may cause if unrestricted.
Also, it is common for larger schemes to have an associated formal legal
agreement (Section 106 Agreement) which obliges a developer to carry out
certain works or make financial contributions to mitigate the impact of
a development on adjoining occupiers and the wider area.
I attach the report to committee and the decision notice for this
development which, for the reasons set out above, addresses all the
objections raised to the development. I note that you have specifically
referred to the siting of the sports hall and waste facilities. I would
particularly refer you to Section 5 regarding the objections received
and how they have been addressed, paragraphs 8.19 and 10.22 - 1.30
regarding the sports hall and Section 14 regarding waste and recycling.
Also, all of the conditions and limitations on the new school are set
out, with their reasons, in the attached decision notice dated 2
November 2007.
Please let me know if you cannot open any of the attached documents.
I trust the above information and the attached documents satisfy your
Freedom of Information request. If you are dissatisfied with the way in
which your Freedom of Information request has been dealt with you can
request an internal review by emailing: [email address]

any of the above documents.
