Dear Sir or Madam,

Following the 12th October 2009, Standard Level Checks will no
longer make checks against the banned lists. It will therefore no
longer be suitable to obtain such checks to work with children
and/or vulnerable adults.

Can you therefore explain what purpose the Standard level check
will serve post October 2009.

Dear Customer Services,

I'm afriad this response doesn't answer my question. You have
answered by stating what information a standard check includes. My
question was specifically around what the purpose of the the
standard check facility since, as it will no longer make reference
to the barred lists, it will no longer be appropriate to use for
roles involving children and vulnerable groups.

Thank you for your email dated 28^th July 2009, in which you express your
concern with the Disclosure service. This has been passed to me for reply.

Standard checks will still be required by some of our service users as not
everyone who requires a Disclosure is eligible for an Enhanced Disclosure.
An example of those who would still require a check at standard level
would be those who work as door supervisors who would not be entitled to a
POCA or POVA check, but still require a standard check carried out.
Following the 12^th October, for a Standard check, as POCA/POVA/List99
checks would no longer exist the only information that would be released
is that information which may be contained on the Police National
Computer.

The Independent Safeguarding Authority (ISA) has been created to help
prevent unsuitable people from working with children and vulnerable
adults. They do this by working in partnership with the Criminal Records
Bureau (CRB). You may also wish to contact the Independent Safeguarding
Authority (ISA) [1]http://www.isa-gov.org.uk/ .

Currently, the POVA list may only be accessed for those working within the
Care Sector such as Care Homes, Domiciliary Care Agencies and Adult
Placement Schemes. List 99/POCA list may be checked for those within the
Education sector. Therefore, not all positions will require a check of
these lists.

Standard and Enhanced Disclosures currently are available only in relation
to posts and positions, which are included in the Exceptions Order 1975 to
the Rehabilitation of Offenders Act 1974. These are generally positions
of trust where there is a valid need to see the person's full criminal
history (including spent convictions) in order to assess their suitability
for a position. A request for a person to reveal their full criminal
history in this situation is known as an 'exempted question'.

An exempted question is being allowed; by virtue of the Rehabilitation of
Offenders Act to ask a person to reveal spent and unspent convictions in
order to assess their suitability for a position of employment, which
involves working with children and or vulnerable adults

The fact that employees may come into contact with children/ vulnerable
adults does not make them automatically eligible for Disclosure. The
Exceptions order is quite specific in its interpretation with regards to
'Working with children'. To be eligible for higher level Disclosures an
individual would need to fall within the definitions of a 'regulated
position' as set out in section 36 (A-H) of the Criminal Justice and Court
Services Act (CJCSA) 2000. Furthermore, to qualify for Enhanced
Disclosure the individual would have to be regularly caring for, training,
supervising or being in sole charge of persons under 18.
