Following no formal response to my ongoing requests for information
on the action taken against David McLean Homes Ltd concerning the
above incident where TPO trees on the estate were allegedly damaged
by employees of this company, I now request sight of the
communications between Flintshire County Council and David McLean
Homes concerning the investigation of this incident along with view
of all letters and logged telephone conversations pertaining to
this matter.

I specifically request sight of a letter sent by your Mr Stuart
Body to David McLean Homes Ltd in late January 2008 highlighting
the issues to that company (this letter was referred to in an email
from Mr Stuart Body to me dated 21st January 2008)

Dear Mr Meredith

I refer to your request for information on the action taken against David
Mclean Homes Ltd by Flintshire County Council in respect of unauthorised
works to a tree within the Pantasaph Conservation Area.

The letter to which you refer was only produced in draft form and the
decision was taken not to pursue the matter further with David Mcleans as
it was considered that there was insufficient evidence available to
prosecute and that prosecution would not be in the public interest.

There has been no formal communication with David Mcleans and no log of
telephone calls.

I have attached Mr Body's record of the site visit on 16/10/07 recording
his conversations with Mr P Winspen ( site manager), Mr Jennings (farmer)
and Mr Mike Cook (David Mcleans).

I trust you find this information helpful however do not hesitate to
contact me should you require clarification or wish to discuss the matter
