Dear Mr Wiper
I had reason to check for signage informing motorists that CCTV
enforcement by Smart Car was in operation in Market St Westhoughton
and whilst both ends of Market St had the required signage in place
there was no signage in two streets that one could enter into
Market from the North side, these streets are Queen St and King St.
In the interests of Justice and Transparency could you please
supply the following information.

1. How many Penalty Charge Notices have been issued as a result of
a Smart Car CCTV device operating on Market St, Westhoughton since
they came into operation in 2009
2. Date the Smart Car CCTV device started operating in 2009
3. How many remain unpaid at the date this request was fulfilled.
4. Please supply a copy of the legislation and or the code of
practice regarding CCTV operation by vehicles

Dear Mr Moss

I refer to your request for information in line with Freedom of
Information Act 2000 and list below the information you require:

1. How many Penalty Charge Notices have been issued as a result of
a Smart Car CCTV device operating on Market St, Westhoughton since
they came into operation in 2009.

Ans: 280 Penalty Charge Notices have been issued on Market Street,
Westhoughton by CCTV camera enforcement from 4th November 2009 to 27th
February 2010 inclusive.

2. Date the Smart Car CCTV device started operating in 2009

Ans: The CCTV Smart car commenced operation on the 19th October 2009
with warning notices and Penalty Charge Notices were issued with effect
from 2nd November 2010.

3. How many remain unpaid at the date this request was fulfilled.

Ans: The number of penalty Charge Notices outstanding at the date
this request was fulfilled is not held, but I can confirm that as of the
2nd March 2010 there is a total of 97 Penalty Charge Notices
outstanding.

4. Please supply a copy of the legislation and or the code of
practice regarding CCTV operation by vehicles

Ans: The legislation covering CCTV camera enforcement is included in
Traffic Management Act 2004: Part 6 Civil enforcement of traffic
contraventions, which may be viewed on the Department for Transport wed
site at: www.dft.gov.uk.
Bolton Council's Code of Practice for Camera Enforcement may be viewed
at www.bolton.gov.uk
