Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Department for
Business, Enterprise and Regulatory Reform's handling of my FOI
request 'Shriti Vadera and Phorm'.

A full history of my FOI request and all correspondence is
available on the Internet at this address:
http://www.whatdotheyknow.com/request/sh...

Please could I ask you to reconsider this request.

I am aware Tim O'Sullivan, BT's Director of PR, stated in an email
to David Hendon (dated 23 April 2008 18:01, disclosed in earlier
FoI requests);

"Do you think we should have any concern that Malcolm says there
have been no discussions with BT (which might imply none between BT
and BERR) when Shriti and ??? have discussed?"

If Shriti Vadera has met with and/or discussed the controversy
concerning Phorm with a senior employee of BT, it seems likely
there would be associated correspondence (both before and
afterward).

I would be most grateful if you would identify the person at BT
with whom Shriti Vadera discussed Phorm, and the date of that
conversation.

Specifically: confirm or deny, that the discussion was with Ian
Livingston, Chief Executive of BT.

Yours faithfully,

P. John

correspondence from Tim O'Sullivan to David Hendon;

15 February 2010

Dear Mr. Rutnam, Ms. Singh

many thanks for your belated reply.

The ICO offers this guidance; "Information which is about the home
or family life of an individual, his or her personal finances, or
consists of personal references, is likely to deserve protection.
By contrast, information which is about someone acting in an
official or work capacity should normally be provided on request
unless there is some risk to the individual concerned."

I asked you to identify a person who was clearly acting in their
work capacity. Given the ICO guidance above, which says a person
acting in an official or work capacity should normally be
identified, I'm disappointed you felt it necessary to conceal the
name of the senior BT employee from me.

Particularly someone at BT who was engaged with a Government
Minister on such a controversial topic, even involving alleged
criminal misconduct by BT.

I look forward to the prosecution, conviction, and imprisonment of
everyone who was involved in the corruption surrounding the
BT/Phorm scandal, and the flagrant criminal misconduct of the past
4 years.

It is an utter disgrace.

Yours sincerely,

P. John
