Dear City of London Corporation,

How much severance pay/redundancy pay has been paid to Senior
Officers employed by the City of London Corporation (ie Assistant
Director and equivalent and above)in the Department of Community
and Childrens Services ( including Housing and Sports Development)
in financial years, 2005/6, 2006/7. 2007/8, 2008/9, 2009/10? You
should be able to provide this information in a format which would
not allow me to identify any individuals.

Following receipt of your request for information on 16 December 2009, and
our acknowledgement of the same date, the City of London (CoL) responds as
follows:

We can confirm that for years 2006/2007, 2007/2008, 2008/2009 there has
been no severance or redundancy payments for Senior Managers in the
Department of Community & Children's Services. However for years 2005/2006
and 2009/2010 there are cases. However, the number is very small and
therefore disclosure of the information you request could result in the
disclosure of personal information about identifiable individuals. When
responding to requests to disclose information relating to a small number
of staff, or former staff, of a small authority it will be relevant to
consider whether disclosure could compromise an individual's privacy at
any time and whether such disclosure would be unwarranted and unfair. We
therefore consider that, although we can confirm that the data is held, on
this occasion we apply FOIA section 40(2) exemption (Personal Information)
in relation to part of your request as we consider that disclosure of this
information would compromise the privacy of individuals. The section 40(2)
exemption is an absolute exemption, i.e. it is not subject to the public
interest test.

Please note that the CoL is the Local Authority for the "square mile"
only, ie the historic City of London, and not London as a whole, which is
covered by over 30 boroughs and the Westminster City Council. Please see

I am writing to request an internal review of City of London
Corporation's handling of my FOI request 'Severance Pay Community
and Childrens Services'.

I would like you to review your decision not to provide information
as requested for years 2005/6 and 2009/10, despite my having asked
for it in a non attributable form.

Following receipt of your request dated 31January 2010 for an internal
review of the response that the City of London (CoL) sent to you on 18
January, and our acknowledgement, also of 31 January, the CoL responds as
follows:

The CoL has reviewed its original response. Since the numbers concerned in
each year are so low, the CoL upholds the decision to use the section
40(2) exemption. The numbers are just one individual in each year
concerned, ie in 2005/6 and 2009/10. The CoL considers that, if such low
numbers were cross referenced with other data, the individuals in question
could be indentified.
