Serious Case Management into children's deaths

Dear Health and Social Care Board for Northern Ireland,

I am requesting information on serious case management reviews that
have been carried out in Northern Ireland for the past 5 years:

Definition -

"10.5 An ACPC should always undertake a Case Management Review
when:
• a child dies, including death by suicide, and abuse or neglect is
known or suspected to be a factor in the child’s death."

Information requested:

a) the amount of CMR carried out for the years: 2009, 2008, 2007,
2006, 2005. the information for each year to be provided seperatly.

b) links to view these CRM's, if that is then possible then said
CMR's whould be made available in written format

c) the breakdown of the residential status of the child involved
based on:living with biological parent, single mother, single
father, government care, foster placement, adoptive placement or
other

d) the breakdown of the perpetrator of the act to the child based
on: mother , father, live in partner male, live in partner female,
boyfriend of parent, girlfriend of parent, boyfriend of parent,
carer or other.

e) a single figure of children abused who are know to social
services that did not result in death for the years: 2009, 2008,
2007, 2006, 2005

Dear Mr McCloy,

In reply to your e-mail sent to my colleague Mr Peter Moran this afternoon I would confirm that I am currently working on a response to your request for information from the Health and Social Care Board in Northern Ireland. Can I firstly apologise for the delay in providing you with a response, I realise the twenty working day deadline has now passed.

Unfortunately because of developments with another request, which is asking for similar information to that in your request, I have been asked to seek an opinion from our Legal Services Provider on the release of this information. As the outcome of this legal advice could have a bearing on how we answer your request can I ask for your agreement to an extension of the timescales to respond to your request.

If you are agreeable, I hope to have a response with you by Tuesday 9th March. Once again can I offer my apologies for the delay in this matter.

i understand that email systems may be down, i am personally
extending the limit to the end of the week, if delivery cannot be

Dear Mr McCloy,

Thank you for your continued patience in this matter. As you will see in my response letter the HSCB has not released copies of the CMR Executive Summaries at this current point in time. This is due to an ongoing assessment being conducted by the ICO as to whether the HSCB breached an individual's rights under Data Protection by releasing one of the CMR Summary reports a number of weeks ago in response to a similar FOI request. Unfortunately the ICO was unable to reach a decision in time for my response to you however it is our intention to publish this information at a future date once the outcome of the ICO assessment has been made.

Should you wish to seek an internal review of this decision please come back to me and I will arrange for it to be undertaken.
