Thank you for submitting the Sequential and Exception Tests for our
comment. The content appears to satisfy the Sequential Test
(subject to some further comments below) but it is most important
that the LPA have seen it and agreed it with you.
It is the Local Planning Authority who is responsible for ensuring
the sequential test has been applied before registering planning
applications as valid. The risk‑based Sequential Test should be
applied at all stages of planning and it's aim is to steer new
development to areas at the lowest probability of flooding (Flood
Zone 1).
Unless we have evidence of sequential tests for major sites we are
unable to process applications and we will maintain an objection
due to insufficient information."

The document that was submitted by Beatrice Libiszewska is;
Appendix A of FRA (attached)
I have also attached an E-MAIL from Jack Hayes (EA) regarding draft
Sequential and Exception Testing.
Please note that this was pre-application advice following our request
to the applicant to include a sequential test in the application. As the
application was submitted in January 2007, this meant that PPS25 had
just been released (Dec 2006) and therefore required the test. The
practice guide had been released on 19th February 2007 so we referred to
guidance in this document but it should be noted that the final version
of the practice guide has been issued in June 2008.
You should note that this information is based on that currently
available as of the date of this letter. We accept no liability
whatsoever for any loss or damage arising from interpretation or use of
this information. You may feel it is appropriate to contact our office
at regular intervals, to check whether any amendments/ improvements have

Jack Hayes (Environment Agency) replied to Beatrice Libiszewska’s (
Waterman Civils) request on 7/3/07 2:59 pm (sic).
Libiszewska’s request is quoted in Hayes’ reply and is dated
06/22/07 05:50 pm (sic). These dates appear to be US styles for
22nd June 2007 and 3rd July 2007 and this may have caused some
confusion for you.
In his 7/3/07 reply to Libiszewska, Hayes said:
“Dear Beatrice,

comment. The content appears to satisfy the Sequential Test

I need to know what response (or responses) Hayes received from
Libiszewska and, if possible, the communications between
Libiszewska and Elmbridge (possibly D.Cliff ?).
The latter exchange may, perhaps, have been quoted in Libiszewska’s
reply to Hayes.

Officer believes that conversations regarding the Sequential Test took

The following text has been taken from the attached letter sent to Ann
Biggs dated 27 August 2008. A copy of this letter has previously been
supplied to you as requested.
"Although the majority of discussion regarding the flood risk assessment
took place prior to the issue of PPS25, the Environment Agency advised
the Developer and the Planning Authority that a Sequential Test would
have to be produced if the application was submitted after the issue
date of PPS25. It was advised that such documentation would still have
to be produced even though the site has a Development Brief and is a
Brownfield site.
Advice was given on a process for carrying out the Sequential Test as
per our flood risk standing advice website. Where the Local Development
Framework (LDF) process has not been completed, this guidance steers
those undertaking the test toward using the existing Borough Local Plan
or similar documents and Environment Agency flood zones to make the
assessment which is done in partnership between the Developer and the
Local Planning Authority (LPA).
The Environment Agency's role is to provide general guidance on the
Sequential Test process and to provide technical flood risk comments.
The LPA are charged with the responsibility for the application of the
Sequential Test in the control of development through the planning
application process. We consider that we are limited in the extent that
we are able to assess the methodology and evidence base of individual
Sequential Tests as this pertains to the wider planning application
decision making process. It is the LPA's role to apply both the
sequential and exception tests and to make the final judgement and
determination on whether or not the Sequential Test meets the
requirements of PPS25. However, we do provide some advisory comments on
the scope and process of the sequential test as outlined above.
We note the information has been produced as part of the FRA and
following further discussion are satisfied that the LPA are considering
the Sequential and Exception tests as part of the process to determine
the application."
