Dear General Medical Council,
this request relates to Dr Anthony William Baker, GMC registration
number 2209887.
This person, allegedly a child psychiatrist, has had two hearings
in front of the Fitness to Practise Panel of the GMC, one in
November 1998 (as reported in The Times, 18th November 1998:
"Doctor told rape girl that father had abused her"; 19th November
1998: "Child abuse expert 'ignored danger signals' GMC hearing
told"; Birmingham Post, 19th November 1998: "Psychiatrist planted
sex abuse memories") and one in October 2008.
He was charged with serious professional misconduct by the GMC in
1998 for behaving indecently and pursuing an improper emotional
relationship with a 15-year-old girl who was referred to him a
fortnight after she had been seriously sexually assaulted.
The - very similar - charges brought in October 2008 relate to his
kissing and fumbling of another female teenage patient of the same
age which resulted in his suspension from 22nd November until 21st
December 2008 (the doctor was about 60 years of age at the time).
This doctor is also known to produce so-called "assessments" for
private family law proceedings in which he acts as a "singularly
instructed expert", i.e. author of reports on persons he has never
met or spoken to, especially women in abusive relationships and
children, for which he takes money via sole instruction by abusive
men without access to full court files. In these he recommends
removal of children into care - children he has (see above) NEVER
SEEN.
BUPA, the private healthcare provider, refuses to pay for this
"expert" who calls himself a "therapeutic pioneer".

This person has been working exclusively in private practice with
no known NHS contract (like many others with a similar background)
and gets his referrals from psychologist and psychiatrist friends
via recommendation through the family courts which are unaware of
his history. All this is information which was, at least at some
point in the past, in the public domain. New "patients" are unaware
of his background and even clients instructing this person are not
told of his GMC history.
Could you please tell me
a) why Dr Anthony William Baker continues to be allowed to see
vulnerable female teenage patients (who have often experienced the
most appalling sexual crimes) without their knowledge of his
background and why he practises without supervision;
b) why all information relating to his misconduct hearings, which
has previously been published on the GMC's website with the full
extent of the allegations, has now been removed and whether it will
be reinstated in order to protect the unsuspecting public;
c) whether this person still produces reports for family courts in
which he recommends the removal of perfectly healthy and well
looked-after children into foster care (plus extensive "work"
provided for by his "clinic") if paid so by one party as a "single
instruction";
d) whether this person is still employed by the Ashwood Practice,
"part of the Baker Duncan partnership", based in Woking / Surrey,
an exclusively private "psychotherapeutic service" which is linked
to the "Ashwood Medico-Legal Consultancy" which produces grossly
misleading reports for private law proceedings.

e) whether this person is employed by any other body. His last NHS
appointment appears to have been around the time his molestations
first became a matter of public knowledge in or just before 1998.
f) whether this person is currently under investigation and what
safeguarding measures have been put into place to protect the
public.
g) whether this person has had any other Fitness to Practise
hearings.
h) how many complaints have been officially lodged about this
person's misconduct and what the outcome of any investigations has
been.
i) whether this person has a duty to inform new "patients" of his
past since they will not be able to make an informed choice whether
they wish to be "treated" by someone with the aforementioned
tendencies unless this is pointed out to them.

respective newspapers' archives; the full FTP Panel hearing 15th -
23th October 2008 has been removed by the GMC and was previously
available on the GMC website. Note that the above doctor practises
under two different first names, "Tony" and "Anthony", and has
lately been calling himself "Professor".

Item 1 - Why Dr Anthony William Baker is still registered
FOIA facilitates the release of recorded information. This part of your
request does not relate to recorded information held by us. I can confirm
that Dr Baker (Registration number 2209887) is currently registered with a
licence to practice.
Item 2 - Why information regarding previous misconduct hearings for Dr
Baker has been removed from the GMC website
In regard to Item 2, previous Fitness to Practice Hearing determinations
can be found under History on the left hand side of the doctor's record on
LRMP. I can confirm that the public minutes for Dr Baker's Fitness to
Practice Hearing in 2008 are available on the website and have not been
removed.
Item 3 - Does Dr Baker produce reports for family courts
In regard to Item 3, this information is not held.
Item 4 & 5 - Is Dr Baker employed by Ashwood Practice & Is Dr Baker
employed by another other body
In regard to item 4 & 5, I confirm that we do not normally keep employment
details for doctors unless a complaint is made to the GMC. As you are
aware, Dr Baker was subject to a Fitness to Practice Hearing in 2008 so I
confirm that we do hold employment details for him as of 2008. We cannot
provide you with further details because an exemption within the FOIA
applies. The exemption that we believe applies is as follows:
Section 40(2) by virtue of Section 40(3)(a)(i) - Personal Information.
This relates to information requested which is about a third party, and
the disclosure of which would be in breach of the Principles of the Data
Protection Act 1998(DPA). In this instance we consider that the disclosure
of this type of information would breach the First Principle, which
requires that the processing of data is fair and lawful. We consider that
the conditions in Schedule 2 of the DPA, relating to the processing of
personal data, are not met and that, therefore, the release of the
information you have requested, would be unlawful.
Item 6 - Is Dr Baker currently under investigation
In regard to Item 6, We cannot provide you with the information you
request because an exemption within the FOIA applies. The exemption that
we believe applies is as follows:
Section 40(5)(b)(i) of the FOIA states that the duty to confirm or deny
whether information is held does not arise if the act of confirmation or
denial would breach any of the principles of the DPA. We believe that it
is reasonable for doctors to expect that if complaints are made against
them which are not progressed to a public hearing, or do not result in any
action upon their registration, whether or not such complaints had been
made would remain confidential. Therefore, we believe that to confirm or
deny the existence or non-existence of the information requested would
breach the first principle of the DPA, which requires that the processing
of personal data is fair and lawful. We consider that the conditions in
Schedule 2 of the DPA, relating to the processing of personal data, are
not met and therefore the release of the information you have requested
would be unlawful.
Item 7 - Has Dr Baker had any other Fitness to Practise Hearings other
than those in 1998 and 2008
I confirm that Dr Baker has not been the subject of any other Fitness to
Practice Hearings or Professional Conduct Committee actions other than
those in 1998 and 2008. Please find attached a copy of the public minutes
for the Professional Conduct Committee in 1998 for your reference.
Item 8 - How many complaints have been received about Dr Baker and what
was the outcome of those investigations
Beyond those complaints that were referred to a Fitness to Practice
Hearing (2008) and Professional Conduct Committee (1998) I am unable to
provide you with additional information in regard to complaints. Please
see explanation provided under Item 6 above.
Item 9 - Does Dr Baker have a duty to inform patients of his previous
Fitness to Practise history
Doctors should subscribe to the guidance provided in the Good Medical
Practice. In regard to informing patients of their previous Fitness to
Practice history doctors should be "honest, open and act with integrity".

will the GMC act?

The GMC licenses doctors to practise in the UK and maintains the register
of qualified doctors. Our Fitness to Practise procedures focus on the most
serious concerns, which call into question a doctor's fitness to practise
and right to retain unrestricted registration - that is his or her right
to work. In many cases concerns about a doctor can best be considered at a
local level, by the doctor's employer.
I understand that the Information Access Team responded to most of the
points raised in your email on 24 March 2011.
With regard to point J, I am writing to request further information about
your concerns. It would be very helpful if you could explain, in writing,
why you believe that Dr Baker is not entitled to refer to himself as a
professor. We are asking for this information to enable us to consider
whether this is a matter that we need to investigate further.

Why was Baker not put on the registered sex offenders list? Surely he has committed (and confessed to) a crime. Seems odd that he can be re-instated as a Doctor.

So far as we know, Dr Baker is not - nor does he claim to be - associated with any college or university, nor does he have any academic papers published. So he is not apparently entitled to use the title 'Professor'

I would like to thank Dr. C.Smith-Byrne for highlighting this doctor. It is unbelievable and worrying that this person should be allowed to continue practising and working with vulnerable children.

Thank you (but I'm not a "Dr"!). The GMC doesn't mind "experts" like Anthony "Tony" Baker, Roy Meadow etc. practising as long as they pay their annual retention fees and don't abuse patients in public but do it behind closed doors.
The first trial Baker had in 1998 collapsed because he was able to afford a skilled lawyer who painted his victim as "not a credible witness" who made "wild and unsubstantiated allegations". As it always happens with paedophiles, some time later another victim emerged who made the same type of allegations...
The Times reported on 18th November 1998:
"A leading child psychiatrist encouraged a 15-year-old rape victim to leave home and have promiscuous affairs, a medical disciplinary hearing was told yesterday. Anthony Baker, who calls himself a "therapeutic pioneer", has been charged with serious professional misconduct by the General Medical Council for behaving indecently and pursuing an improper emotional relationship with his patient. He denies the charges.
Miss X was referred to Dr Baker by her GP two weeks after she had been seriously sexually assaulted in 1994. As a partner in the private Baker & Duncan Consultancy in Woking, Surrey, he was an internationally recognised expert on childhood sexual abuse. But her ordeal was "hardly ever brought up", she said.
Instead, Dr Baker spent counselling sessions over seven months encouragin her to become a lesbian, suggesting that she should masturbate behind a screen in his room, advising her to have sex with strangers, hugging her and offering to buy her a vibrator.
Dr Baker, 50, constantly criticised her parents, planting in her mind the suggestion that her father had sexually abused her, she said.
The General Medical Council said it was the first time a disciplinary hearing had involved a case of doctors using "recovered memories" techniques.
The girl's parents ended the sessions he held in a darkened room of his home in Haslemere after he prescribed a stay at a health farm, she said. She had run away from her parents and spent the night at his house at his invitation.
Miss X came from a comfortable home in Surrey and had done very well at school, said Linda Strudwick, for the General Medical Council. However, Dr Baker quickly branched into two separate areas of therapy, concentrating on her relationship with her parents and on her sexuality. "This included planting the suggestion in her mind that her father had sexually assaulted her and that she should sue him," Ms Strudwick said. "This did not help the confused 15-year-old, who was not even any 15-year-old, but one who had suffered sexual abuse."
At first, Dr Baker told Miss X he would work through her feelings about the rape so she "could come out at the end feeling happy".
He treated her with practices such as "the cushion game", which started when they were both sitting on the floor and looking at some ornamental stone eggs, said Miss X. Dr Baker said the eggs were "making love" and then suggested a game in which they push a cushion between them.
Despite her reluctance, Dr Baker pushed the cushion so hard towards her he ended up lying on top of her, she said. "It sounded like a sexual act. I was petrified, I thought he was going to rape me."
Ms X's anxiety about men and sexual relationships was countered by Dr Baker encouraging her to become a lesbian. His first suggestion was that I should go to women instead of men, then to experiment with strangers. "He said I shoud "get f" by men and get paid for it, because why not?"
She said he suggested she masturbate behind a screen in his room, where he could teach her. He offered to buy sex videos they could watch together and suggested she use sex toys which he would buy.
He tried to hypnotise her on two occasions in which he would narrate sexual acts to help her to achieve an orgasm, she said. "The voice he used to say it made me cringe, almost as if he was getting sexual pleasure out of it." He hid the tape he made of their hypnosis session so that her mother would not find it when she took it home, she said.
He told her her mother's strictness did not allow her to be free sexually, she said, and he disclosed details of a nervous breakdown her father had had years ago, a breach of confidence that forms part of the charges against Dr Baker.
He became increasingly preoccupied with talking about her family and hugging her, she said. "I finally said maybe my father did hit me. He had a look of triumph, and hugged me for a long time."
She became very upset and he suggested she file a lawsuit against her father for abuse, she said, and then that she spend some time at Grayshott Hall. He visited her on three of the four evenings she was there, ending with an emotional session where he sat on the bed in her room and told her she had "really nice legs". She said: "He suggested I should not return home and that I should be fostered as I had bad parents."
By this time the teenager, who had been close to her parents, had become secretive, argumentative and isolated, said Ms Strudwick. She went to his house where he greeted her like a long-lost relative, telling her "I almost kissed you.""
In his Fitness to Practise hearing in 2008 the notes read as follows (excerpt):
"The Panel will inquire into the following allegation against Dr Anthony William Baker MBBS 1974 Lon, LRCP 1974 Royal College of Physicians of London, MRCS 1974 Royal College of Surgeons of England.
That being registered under the Medical Act 1983
1. Between in or about January 2004 and July 2006 you had regular consultations with Patient A in your capacity as Consultant Psychiatrist for the Basingstoke Child and Adolescent Mental Health Services at xxxxxxxx a health centre;
2. At the end of those consultations you,
a. regularly hugged Patient A, [Found not proved.]
b. occasionally kissed Patient A on the top of her head as you were hugging her, [Found not proved.]
c. on one occasion, before Christmas 2005, you
I. tried to kiss Patient A on the lips; [Found proved.]
II. ended up kissing her on the face; [Found proved.]
[...]
5. You did not maintain any or any adequate medical record of your consultations with Patient A; [Admitted and found proved.]
6. Your actions set out at paragraphs 2a, 2b, 2c, 3, 4 and 5 above were,
a. inappropriate,
b. not in the best interests of Patient A,
c. below the standards expected of a Consultant Psychiatrist;
And that by reason of the matters set out above your fitness to practise is impaired because of your misconduct."
"You told the Panel that it was Patient A who first suggested the possibility of staying at your home and that you replied ironically with words to the effect, "Oh yes, and what are you going to tell your mother, that you are staying with friends?""
"The Panel is clear that trying to kiss a young vulnerable patient on the lips is clearly inappropriate, not in her best interests and below the standards expected of a Consultant Psychiatrist."
"The Panel is in no doubt that the misconduct found proved is serious and that your behaviour has fallen far short of the standards expected particularly of a consultant psychiatrist working in child and adolescent mental health."
etc. etc. - and the story goes on...
I would like to advise the persons who have contacted me because they, too, have been victims of this ruthless "expert" with no moral compass whatsoever (some have lost their children due to his "evidence", others have had them touched and fumbled) to pass their concerns on to the GMC. This body may be able to fob one complainant off, maybe two, even three... - but will not get away with putting its head in the sand once ALL Baker's victims have come forward.

Very distressing reading. On GMC website nothing listed about 1998 case, history since 20/10/05 .Is he qualified for adult psychiatry, otherwise how is he qualified to do expert reports on adults? He is now visiting professor to Kingston University (Guardian Tues 10/5/11)Welfare and legal aid cuts.

No, he is not - please read my FOI request sent to Kingston University. I look forward to the answer the GMC is going to provide to my latest FOI request of today's date (10th June 2011).
This person is not qualified to provide "assessments" on adults, but very devious and skilled at bypassing this little deficiency. How? He offers his services as a "family assessor" which obviously includes not only the child(ren) but also the parent(s). This appears to be legal - done by a myriad other "experts" - and what makes Baker stand out is his GMC accredited ability (?) to do this without any knowledge whatsoever about the real people he writes about.
What is truly astounding is the fact that doctors who help alleviate pain and suffering are struck off by the GMC although no-one is harmed (but helped) in the process, whereas others who cause nothing but untold damage and suffering to fulfil their primitive needs (greed, sexual gratification, power) and interfere with the most vulnerable members of society, children, can get away doing this unpunished by the bodies created to control and supervise them.

Thank you C. Smith-Byrne for letting Kingston University know the position about this arrogant, grandiose Dr Antony William Baker. The GMC seem very hot on striking off doctors who offer patients "the Bible" in times of pain but do nothing about Baker who work with vulnerable children. Perhaps the University should review how they employ people.

It's vital that Kingston University is held to account when they hire persons of questionable character to lecture to young people. I would have serious concerns for the safety of my child were I to send them to a place that would hire such a person as Mr Baker.

Thank god there are people like you Mr C. Smith-Byrne its refreshing knowing others that have real strong concerns where children and vunerable are concerned. It sickens me that so much of this type of abuse goes on and it seems in majority of times the offenders get away with it. you get higher penalties for having no car tax or some minor default on a vehicle than what these vile people get in regards to punishments.
i will be looking forward to all the latest responses in regards to this.

I was unlucky enough to be in an adolescent unit in a notorious Epsom hospital 28 years ago.Dr Tony Baker was not my Dr but my friends he was inappropriate with her on more than 10 occations. When there was an incident between myself and an adult male staff (witnessed by a female nurse who reported it) Dr Baker made crude and unrepeatable comments to me about the incident.The abusing nurse was not disciplined but not allowed on the girls dorms anymore-big deal the abuse happened in the kitchen!!

This is precisely the reason for why I am posting this. Anyone who has ever attempted to find out more about the mindset that makes paedophiles tick knows that IT IS NEVER A FIRST INCIDENT that people read about in the news, but it may be the first time it has made it into the papers. The abuse often stretches back many, many years and previous victims only come forward once they realise they were not the only ones. The shame, guilt and intimidation prevent many from seeking redress and an apology.
The General Medical Council will not perform its duty - which it is paid for by taxpayers and decent doctors to perform - to weed out the misfits, abusers and obvious dangers to society.
If I have reached only one person who has been ordered to attend this "sex abuse expert" (with extensive knowledge from own practical experience) - be it the child or adolescent him-/herself or a concerned parent - and this person has managed to escape "therapy" with this man, then I have performed my duty as a parent better than the GMC.
It would still be worth considering for you or your friend to report this individual to the GMC. Baker is now over 60 years of age, but how else would they know of the trail of misery he has left behind?

The above is an appalling indictment of the GMC. I too have had dreadful service from the GMC and lost confidence in them as a regulatory charity.
After reading the above, I believe the time has come for those at the GMC, allegedly culpable of acting in concert, or aiding and abetting criminal acts to be subject to criminal AND civil proceedings themselves.
If the GMC are not able to make their organisation fit-for-purpose, then the GMC and any miscreant of the 600+ employees at the GMC should be hauled before the criminal and civil courts.

It is a well known fact that a child or young person who is sexually abused is quite likely to become a victim again.What hope is there for that child if the very person they are sent to get help from is also a predator. How hard would it be to speak out again, and against a proffessional? I wish more people could see this there must be many more people/survivors who are left thinking it must be something about themselves that makes them targets.It's never their fault.

Doesn't all this make you wonder about those that choose to work with someone with Bakers history? Why would anyone with the best interests of children and young people at heart even risk it? I bet a lot may feel if the GMC are ok with him practising maybe they should be ok with it too.

My sister was in the same Unit at Epsom as Lacy in the early 80's. Baker never went away when she was discharged, blaming my father,me then my mother. I am not going to reveal everything here just to say I am shocked but also helped in that it was not just us.My parents are dead now so nothing can be gained to console them.
This man has destroyed my life.

My family were recently assessed then reassessed by a collegue of Bakers as part of court proceedings re my kids. She informed me that she had worked in the Unit whilst I was there and she remembers me. I did not remember her though I only really have strong memories of friends and particularly nice or abusive staff-like Baker.I recently gave a detailed account of abuse at the unit and when the police contacted this woman she said it was unlikely to have happened - she would have known!! The police believed me.They all have to accept some responsibility for what happened to us kids, I had spent aweek on the adult ward where I had been drugged and raped I reported and and received medical treatment but it did not transfer in my notes to the adolescent unit when I was moved and though I talked about it I was told to "let it go,"as it was not the reason I was there.

Dear Tahir,
Do send your complaints to the General Medical Council. They may not do anything, but are the body legally responsible to regulate paedophiles such as Baker (which they fail to do, of course). There will come a time when they will all be held accountable for covering up for those criminals.
Your posting is yet another proof that these men are allowed by their professional regulatory bodies to carry on with the abuse without any fear of repercussion. Thank God there is the Internet... - the only thing criminals such as this "shrink" fear nowadays is publicity and I do hope that any parent/grandparent/carer whose child has been forced do undergo "therapy" via this pervert is alert enough to search for names before they commit their loved one(s) to a life of misery.
I have forwarded my paperwork to an organisation which collects evidence of bribed "expert witnesses" in court proceedings and have been approached by a journalist regarding the publication of these details in a paper which will reach potential victims. There are - and I have evidence for this from my own research and that of other parents - numerous other "psychiatrists" and "psychologists" around who benefit from the free money-for-all (for "expert witnesses", that is) which is dished out so generously by the government. Two other "family clinics" to be VERY BEWARE of are the Marlborough Family Service and the Monroe Family Service in London, both associated with the infamous Tavistock and Portman Clinic which have pioneered the use of psychotropic medication in children (in association with the Anna Freud Centre). There is a "consultant psychiatrist" called Dr Karl Michael Asen (who does not wish to be recognised to be German - why? - and has renamed himself "Eia" instead) who runs the Marlborough and has been repeatedly reported as threatening parents with "bad reports" if they do not agree to undergo "assessments" with him for tens of thousands of pounds (some of this has been recorded by "service users" on tape). I would urge anyone who is forced to see Asen, Baker or any of the other crooks to tape everything during such "assessments" (which are nothing to do with medicine or psychiatry) and keep them safe for possible publication later (this is currently regarded as "contempt of court", but things are changing gradually and the laws protecting such people are under review).
Note that these men are very apt at portraying themselves as "experts", yet there is absolutely no control or peer review for what they are doing behind closed doors. They are not subject to any competence check and can often go undetected for many years, giving convincing talks, forming firm bonds with the judiciary (who is unable to distinguish between the good, the bad and the evil due to lack of training) and conning colleagues.
