The legislation which states what Ministers expect authorities to
keep under review ie. their criteria and flexibility on safe routes
to school when an Assesment is being made on a Road.
e.g. taking into consideration increased volume of traffic and
availability of sufficient pavements.

Dear Mr Cannop

Thank you for your email.

At present, I am unable to determine what information we can provide to
you in response to your request. Please could you clarify what
information you are requesting from the Scottish Public Services
Ombudsman, and what is meant by 'review', and I will look into this
further. The request seems to be asking for the Scottish Public
Services Ombudsman to identify and provide the precise primary
legislation (Act or Acts, and/or associated secondary Regulations) that
set out what a Minister would expect authorities to keep under review.
This request might be more appropriately directed to the Scottish
Government.

I look forward to your response.

Yours sincerely

2 December 2009

Dear Mr Cannop

Thank you for your email of 26 November 2009.

I apologise that I am still unable to determine what information I am
able to provide to you in response to your request. Please could I ask
you to explain why you think this office holds the information, for
example, does this relate to a complaint that has been considered by the
Scottish Public Services Ombudsman? If this is the case it would be
helpful if you could provide further details so that I am able to locate
the complaint in question.

With regard to your email of 1 December 2009 in which you request a
review of the handling of this information request, I have forward your
email to Niki Maclean, Head of Corporate Services, for consideration.

Yours sincerely

7 December 2009

Dear Mr Cannop

Thank you for your email of 2 December 2009.

If the SPSO holds information you are requesting we are more than happy
to provide this to you under the terms of FOISA, however, I apologise
that I am still unable at this stage to establish what information you
are asking for.

For admin purposes, I am therefore closing this request, but this in no
way prevents you from clarifying your request in the future, which I
would be happy to try to respond to.

Following your request of 1 December for a review of the handling of
your information request, Ms Maclean has advised that it is not
appropriate in the circumstances to conduct a review because at that
stage no decision response had been issued to you request.

I apologise that I have not been able to help you further.

Yours sincerely
