D <<Final Response 58089 - Thackeray 06 03 09.DOC>> ear Mr Thackeray,

58724- Mr Thackeray - Outcome of Internal review into time complaint.

I understand that you have made an enquiry as to why you have not
received a reply to your request for an internal review.

I have attached a copy of the internal review response I sent to you on
23 March concerning the time complaint you made about our handling of
your request dated 9 February.

My review found that we had answered your request within the 20 working
day statutory deadline set out in the Act.

On 9 February 2009 - You sent a request to the Customer Services of CSHQ
for Scientology gifts.

On 9 February 2009 - Mr Lance Holden in HMCS responded to your request -
he confirmed that your request was too costly and it was refused on cost
grounds (letter attached); he also explained how you could refine your
request so that it fell within the cost limit, meeting our obligation to
provide advice and assistance as laid out in section 16 of the Act.

On 16 February 2009 - You attempted to refine your request.

On 6 March 2009 - Mr Luigi Leo wrote to you to seek clarification of
your request as it was still not clear what information you wanted
(letter attached).

All our responses to your requests were handled within the 20 working
day deadline; I was satisfied that we did respond to your requests
within statutory deadlines.

I hope that this response clears things up.

Yours Sincerely,

Michael Evans| Senior Reviews and Appeals Officer | Data Access &
Compliance Unit |Ministry of Justice | 020 3334 3237.

Dear Michael,

Many thanks; I had not previously received your department's
letters dated 9 Feb and 6 Mar, and I am grateful for the
information released in these letters.

Re Mr Leo's query of 6 Mar: the whole of the Tribunal service, if
this will fit within the cost limit.

Yours sincerely,

William Thackeray

Thanks for your e-mail dated 11 December in which you clarified what
information you wanted.

In order to ensure that there is no further misunderstanding as to what
information you want from the Tribunal Service can I confirm that your
request for information should read: "Please provide a list of all
gifts, hospitality or donations supplied to the Tribunal service by
Scientology organisations, over the past 5 years."

Once you have confirmed that this is what you want I will then forward
your request to colleagues in the Tribunal service to consider.

Dear William Thackeray,

SUBJECT: Freedom of Information Request

Thank you for your correspondence of December 11, 2009, in which you
asked for information about Scientology gifts under the Freedom of
Information Act 2000 (FOIA) from the Ministry of Justice (MoJ).

You will receive a response from us by January 13, 2010. Your request
has been passed to the appropriate business unit within the MoJ, and
they will write to you with their decision by this date.

The FOIA does provide a number of exemptions. A qualified exemption
requires that before relying on it we must consider the public interest
test. If the information you have requested is covered by a qualified
exemption(s) under FOIA, the Department is allowed to take longer than
20 working days to respond. This is because in such circumstances we are
required to consider the public interest issues when deciding whether or
not to disclose the information requested.

If more time is needed to consider the public interest issues under a
qualified exemption(s), we will write to you and inform you of the
revised date you can expect to receive a response to your request.

If you have any queries regarding this request please do not hesitate to
contact us. Please quote ref: FOI/62633/09 in all future correspondence.

Yours sincerely,

Darren Over
