Dear Sir or Madam,
Please release the employment contract of former FTP panellist
Christopher Brightmore, and any related information.
This request relates to Information Tribunal hearing EA/2009/0063:
GMC solicitor Toni Smerdon has advised me that if I wish Mr
Brightmore's employment contract to be included in the evidence
bundle for that hearing, then I must request it under FOI; hence
this request.
I believe there is a 'legitimate interest' of the public (under the
DPA) in disclosure, as shown by the evidence of Mr Brightmore's
membership in CCHR (a Scientology organisation) and CCHR's campaign
against psychiatrists, contained in the hearing bundle for
Information Tribunal hearing EA/2009/0063.

Dear Mr Thackeray
Thank you for your email below. Your request has been considered in
accordance with the Freedom of Information Act 2000 (FOIA).
You have requested a copy of Mr Brightmore's employment contract. As
panellists are not employees of the GMC, we do not hold an employment
contract for Mr Brightmore.
However, we do hold a copy of the Conditions of Service, signed by Mr
Brightmore. This is a standard agreement that all panellists were
required to sign at the time of Mr Brightmore's appointment.
I understand that you have already received an unsigned copy of the
Conditions of Service. In relation to the copy signed by Mr Brightmore,
we consider this to be exempt from disclosure in accordance with the
following exemption listed in the FOIA:
Section 40(2) by virtue of section 40(3)(a)(i) - Personal information of
a third party. This concerns information requested which relates to a
third party, and the disclosure of which would be in breach of the
Principles of the Data Protection Act 1998 (DPA). In this instance we
believe that to release Mr Brightmore's signature into the public domain
would breach the First Principle of the DPA, which requires that the
processing of personal data is fair and lawful.
This exemption is absolute, which means that it is not subject to a
public interest test (in order to assess if the public interest is
greater served by disclosing the information than maintaining the
exemption).
You have the right of appeal against this decision. If you wish to
appeal please set out in writing your grounds, and send to Julian
Graves, Information Access Manager, [email address]. You also have
the right of appeal to the Information Commissioner.
