Response to this request is long overdue. By law, under all circumstances, Rush Common Primary School should have responded by now (details). You can complain by requesting an internal review.

Dear Rhian,

Thank you for your email with attachments.

Unfortunately you have not supplied all the information I requested
and therefore have not complied with the terms of the Freedom of
Information Act.

I specifically asked for:

i) The Schools healthy eating policy or similar healthy schools
policy?

ii) A copy of the Governing Body Minutes confirming it's proposal
and ratification?

You have provided me with a school policy titled " Policy for
Healthy Eating/Nutrition" dated and agreed by the Head teacher,
Maxine Evans, on 30th November 2007.

This policy bears no relation to the FGB minutes dated 22nd March
2005 as these minutes simply refer to the school's intention to
adopt the 'model' policy from the County.

I therefore still require:

i) A copy of the 'model policy' as referred to in the Full
Governing Body (FGB) minutes on 22nd March 2007

ii) A full copy of the FGB minutes from 22nd March 2005 (as the pdf
copy supplied to me is marked as 'Page 1' on the bottom right of
the page), therefore, please supply the FGB minutes in their
entirety as signed by Chair of Governors.

I also require to know:

iii) The author of the School Policy titled "Policy for Healthy
Eating/Nutrition" dated 30th November 2007

And

iv) When this policy (as published and provided to me) was
presented to the FGB for approval and ratification and any
Governing Body minutes or committee minutes that refer to the
acceptance of this school policy by or on behalf of the Full
Governing Body or a note of the delegated decision making process
if appropriate.

Yours sincerely,

James Martin

Further to your recent email, please find response below.

i) A copy of the 'model policy' as referred to in the Full
Governing Body (FGB) minutes on 22nd March 2007

It is presumed you mean 22nd March 2005. There is no record of a 'model'
policy for healthy eating/nutrition being ratified by the Governing body
in 2005.

ii) A full copy of the FGB minutes from 22nd March 2005 (as the pdf
copy supplied to me is marked as 'Page 1' on the bottom right of
the page), therefore, please supply the FGB minutes in their
entirety as signed by Chair of Governors.

A full copy of the FGB minutes from 22nd March 2005 is attached.

I also require to know:

iii) The author of the School Policy titled "Policy for Healthy
Eating/Nutrition" dated 30th November 2007

It was authored by the pupils of the Eco-School Council and Coordinator
for Healthy Schools (Mrs Corrigan), in conjunction with the LA
representative for Healthy Schools and in line with recommendations for
our Healthy School status. Aspects of this policy are 'model' as
recommended to us, others distinct to the context of our school.

And

iv) When this policy (as published and provided to me) was
presented to the FGB for approval and ratification and any
Governing Body minutes or committee minutes that refer to the
acceptance of this school policy by or on behalf of the Full
Governing Body or a note of the delegated decision making process
if appropriate.
There is no legal requirement for the FGB to approve or ratify the policy
and as such no minutes exist. However, since your request was made the
policy (although it is non-statutory) was presented to the Performance and
Standards sub-group on 16th June 2009. It was agreed that the policy
should be formally adopted and this recommendation will be ratified at the
FGB meeting on 7th July 2009. Minutes of both these meetings may be
obtained once signed off and published.
