Dear Sir or Madam,
This request relates to the scheme referred to in Budget Note 66
(2008).
HMRC’s original strategy for dealing with the scheme had been
through litigation. Test cases had been selected, Closure Notices
had been issued (and appealed), and HMRC had stated that it
intended to list the appeals for hearing at the Special
Commissioners.
At some point, HMRC completely changed its strategy and decided to
go for a legislative response instead.
In this context, please can you supply dates (dd/mm/yy) for the
following. Where the exact date is not known, please specify Month
and Year.
(1) When was the decision taken not to go ahead with listing the
appeals for hearing at the Special Commissioners?
(2) When was the use of retrospective legislation first considered
within HMRC?
(3) When did HMRC first notify HM Treasury of the existence of the
scheme?
(4) When did HMRC first suggest the use of retrospective
legislation to HM Treasury?
Yours faithfully,
Nigel Jagger
