s58 FA2008 - When did HMT first learn of the scheme?

Dear Sir or Madam,
HMRC have admitted to knowing about the scheme since 2001. In the
latter half of 2002, they negotiated concessions with one promoter
"Murilo Ltd", and allowed its users to walk away with a tax
advantage. In June 2003, they began opening enquiries into other
users of the scheme. According to figures obtained from HMRC
through FOI, by the end of 2004 they had placed over 600 tax
returns under enquiry.
Therefore, by the time the retrospective legislation was announced
in Budget Note 66 on 12th March 2008, HMRC had been aware of the
scheme for 7 years, carrying out extensive enquiries for 5 years,
and sitting on 600+ tax returns for over 3 years.
Now this begs an obvious question. How long had the Treasury known
about the scheme prior to the BN66 announcement?
Please can you confirm on what date the Treasury first learned of
the existence of the scheme and how they became aware of it.
