I am looking in to the close relationship with yourselves & the
rspb as jncc should be very independent but could be influenced by
the rspb. Can you tell me how many rspb members are paid by jncc .
This is to include all members that work for jncc in a full time
capacity or a part time capacity or any influencing role that is
paid for by jncc. For any type of work.This also will includ
working for jncc but paid by any other bodey. This is to include
any one who is a member or a board member of the rspb from 1983 to
2009.

Dear Mr Robb,
Ref 09/10_10
The internal review of the handling of your request for information about
RSPB members working for JNCC has been completed.
The review was conducted by the Biodiversity Research Manager who is
unconnected with either JNCC's Business Unit or Personnel team which were
directly involved in handling your request.
The appeal for internal review received by JNCC on 25 June 2009 did not
state the reason for appeal and, despite a timely request for further
information from you, no further clarification of has yet been received by
JNCC.
The conclusions of the reviewer were as follows:
. The request was correctly handled under the Freedom of
Information Act;
. The time limits recommended by the FOIA Code of Practice for
responding to the request and subsequent appeal for internal review of the
decision have been met by JNCC.
. In our response to you we:
o correctly advised you that JNCC does not hold part of the information
requested. However, we should have explained that even if JNCC did hold
this information or obtains it in future it would be exempt from
disclosure under the Act.
o correctly referred you to the pages of our website through which you
could obtain the part of the information requested that we do hold.
However, we should have explained why we did not directly provide the
information requested with our response.
Accordingly:
. we advise you that staff membership of the RSPB is deemed
personal. For this reason, even if JNCC were to hold such information,
which it does not, this would fall under the exemption from the duty to
provide information on request when that information is personal
information (section 40).
. we advise you of the reason we referred you to our website for
information about JNCC Committee members membership of RSPB rather than
directly with our response. This is because this information falls under
the exemption from the duty to provide information on request when that
information is reasonably accessible to the applicant by other means
(section 21).
