Dear Sir or Madam,

Please provide a copy of the risk log presented to the Accounts and
Audit Committee of the SNDC on 26 september 2008 (i.e. Item 6
Appendix A).. as no matter what software package is used it is
identified as being corrupt. Three different application packages
have been used trying to access the information (all supporting pdf
format - and they all identify that that content is corrupt.

Could you please also provide details of any interoperability
testing engaged in by the SNDC before posting information on its
website.

Dear Mr Carruthers

I refer to your request which is being considered. You are aware that we have 20 working days in which to respond to FOI requests and you will therefore hear from me again by 11 November 2008 or earlier if possible.

For your information, the Act defines a number of exemptions, which may prevent release of the information you have requested. There will be an assessment and if any of the exemption categories apply then some or all of the information may not be released. You will be informed if this is the case, including your rights of appeal.

There may be a fee payable for ‘reasonable disbursement’ costs such as postage and photocopying. This will be considered and you will be informed if a fee is payable. In this event the fee must be paid before the information is processed and released. The 20 working day time limit for responses is suspended until receipt of the payment.

Further to your FOI request below, please find attached a copy of the Risk Log as requested.

In terms of your second request, I should advise you interoperability testing is not relevant when posting information on our website as interoperability, in an IT sense, relates to the ability of different computer systems to work together. As the information requested does not exist, the Council is unable to provide it.

Dear Right2Know,

1. I am fully aware of the meaning of interoperability.

2. The report forwarded is different to that which was posted by
the SNDC (has a different name), and it is still corrupt. It is
also not viewable in HTML format on the Whatdothey know site 3. An
uncorrupted copy of the SNDC report has not been made available on
its own website; 4. The reports to the SW Planning Committee on 04
November 2008 are not available.

Review is requested - as it is reasonably clear that the SNDC is
simply seeking to obfuscate and refuse access to information.

Dear Mr Carruthers

All the information you requested has been provided and is additionally available on the website and so I am unable to provide anything further.

I note that you have asked for an internal review of my decision. It would appear that you have misunderstood the purpose of the internal review panel in relation to FOI requests. Perhaps if I explain the situation again, this may assist you.

When a request for recorded information is refused using an exemption as laid out in the Freedom of Information Act 2000, then the requester has the right of appeal against that decision. The first stage of that appeal process is to request that the public body refusing the information convenes an independent panel to examine the decision and the reasons behind it. They will then either uphold the decision and refuse to supply the information, or overturn the decision and release the information. If the first course is followed and the information is still not released, then the requester may appeal to the Information Commissioner.

Under the request for information which has been given the identifier FOI 08-176, I have provided you with all the requested information. I have therefore not refused to supply any information to you and thus it is not possible for a internal review to be convened to examine the refusal, as there has been no refusal. No action will therefore be taken on your email.

s(1) of the FOI is reasonably explicit. The content provided and
signposted is not accessible (i.e. the risk log). IT IS IDENTIFIED
AS BEING CORRUPT.. different applications etc..

consequently you are not supplying and /or making available the
content requested.. you are merely identifying that a right exists
to corrupt content that should be accessible. It is not.

Scheme and can access this now.. as it is now available.. and was
made available after decisions were made.. etc..

It is the Risk Log that is not accessible.. A copy of this has been
forwarded.. to you and it is not accessible. Please provide a copy
that is accessible.

Firstly, it will clearly assist if you quote the FOI number associated with each request as you appear to be confusing your emails.

Secondly, I will repeat once more the position in terms of the Risk Log. It is available on the website, I have sent it to you as an attachment to an email and finally I have offered to send you a hard copy if you provide me with your postal address.

I can do no more and unless you provide me with your address, shall take no further action in relation to any emails relating to the Risk Log and shall simply file them.

Francis Irving left an annotation (13 November 2008)

The corruption when looking at the file with "View as HTML" is entirely WhatDoTheyKnow's fault - well, the software we use to convert PDFs to HTML.

Please use the "Download" link to get an uncorrupted version.
