Dear Wyre Borough Council,
I make this request under the Freedom of Information Act.
I believe that Wyre Borough Council owns/uses lawn mowers/grass
cutters that are licensed for being driven on the public highway.
1/ Please supply detail of all risk assessments, conducted at any
time and in any situation, associated with these vehicles.
2/ Please also supply all details as regards such vehicles being
involved in road traffic collisions and/or other accidents whilst
on the public highway.
3/ In relation to point number two please supply all dates and
locations of these road traffic accidents involving lawn
mowers/grass cutters in the year 2009. Please also supply all
documentation as regards any Wyre Borough Council action in
relation to any of their lawn mowers/grass cutters being involved
in any road traffic accidents whilst on the public highway. In this
I refer to any subsequent risk assessments or any remedial measures
taken to lessen the likelihood of such accidents reoccurring.
4/ Please also provide all details of injuries caused to members of
the public by Wyre Borough Council's lawn mowers/grass cutters
involved in any road traffic accident. Of course I don't require
any personal information here but merely data of a general nature.
5/ Please supply dates, times and locations of all accidents on the
public highway involving Wyre Borough Council lawn mowers/grass
cutters that caused the police to attend.
If any part of this request is difficult to understand or confusing
please make contact and I will do everything in my power to assist.

Dear Bedford, Colin,
I will be seeking an internal review of this request after taking
advice. Your response is staggeringly unacceptable. For instance
out of the whole of Wyre you have provided risk assessments for 2
areas but, amazingly none for notorious accident blackspots on
public highways with a recognised speed limit. Your response also
contains evidence of blatant lies in relation to reported injuries
at the accident of 30 June 2009.

We acknowledge receipt of your request for an FOI internal review. I will shortly be initiating this process which will be undertaken independently by the solicitor to Fylde BC.
This process normally takes a few weeks, and due to this being an independent review, I will not be able to keep you informed about its progress. The reviewer will contact you directly with his decision and at the same time instruct this council what remedial action, if any, it should take.

Dear Bedford, Colin,
The point is that WBC have made this ad hoc arrangement with FBC
and my experience of it to date is not good. The request was made
to WBC and therefore the responsibility for this request is yours
not FBCs. The reviewer has no statutory sanction available to it in
the event of non compliance. That is your responsibility and remit.
So please cease being totally unhelpful. You referred the requestor
to FBC so find out quickly who the reviewer is and pass it to me.
This ad hoc arrangement clearly doesn't work well if WBC wishes to
be awkward. I don't really know how lawful the arrangement in any
event. This concern is compounded if an officer of the original
organisation where the request was made chooses to be intransigent
and manifestly unhelpful.
Due to your tone and unhelpful nature please pass this email as a
complaint to whomever deals with such matters. You cannot merely
wash your hands of a statutory process purely because you choose to
have some arrangement with an unrelated public authority. Then
being singularly unhelpful compounds the matter. Please pass this
email on to a complaint officer.

legislation. I know that the FOI Act is not welcome at public
authorities but please, at least, pay lip service to it.
