Dear Sir or Madam,
in August last year I asked you to provide me with statistics
relating to RIPA part 1 offences in 2008 (*).
At the time you told me;
"The Ministry of Justice holds information on defendants proceeded
against, found guilty and sentenced for criminal offences in
England and Wales. However, the data for 2008 will not be available
until much later this year. I therefore regret that, at this time,
we are not able to provide you with the information you have
requested. "
The Interception Commissioners Report for 2008 stated that "During
2008 the Tribunal made two determinations in
favour of two separate complainants. These are the second and third
occasions that the Tribunal has upheld a complaint, the first being
recorded in the final Annual Report of my predecessor, Lord Brown,
for 2005-2006."
Please will you disclose for me for the year 2008;
- How many people were charged with Part I (interception) offences
under RIPA?
- How many people were cautioned for Part I (interception) offences
under RIPA?
- How many people were convicted of Part I (interception) offences
under RIPA?
- How many people were fined for Part I (interception) offences
under RIPA?
- How many people were gaoled for Part I (interception) offences
under RIPA?
Please could you provide similar statistics for Part II and Part
III RIPA.

for RIPA offences statistics for 2008 under the Freedom of Information
Act 2000 (FOIA) from the Ministry of Justice (MoJ).

I have not asked you to conduct an internal review.
I am still awaiting the information originally requested from you
on 5 January 2010. That information should have been provided to me
promptly and not later than 2 February, and remains overdue at the
time of writing.
Only once that information is in my hands will I consider whether
it is necessary to request an Internal Review.
This matter is also subject to a written complaint to the
Information Commissioner's Office.
MoJ are presently breaking the law.

Further to my request for the names of those who
were cautioned for the RIPA s.1(1) offences in 2008, I understand
that victims have the right to request the name and address of
persons who accept a caution (see *) with a view to initiating
civil proceedings.
Please could you comply with the obligation to disclose the name
and address of those cautioned when preparing your response.
If possible I would be most grateful if you could also include the
details of the Police force that issued the four cautions, the
circumstances in which the cautions were issued, and details of any
conditions associated with those cautions.
