RIGHT OF WAY ?

Julie Shrive (Account suspended) made this Freedom of Information request to Department for Transport

The request was refused by Department for Transport.

From: Julie Shrive (Account suspended)

28 May 2009

Dear Sir or Madam,
Is it legal for a skip lorry to block the road so one can't turn
round ? My disabled Kangoo van/car carrying disabled scooter has
had its rear windscreen wiper knocked off by a lampost painted
black [ camouflaged] because road so narrow.
Why do police not want to know say civil and firm Brewers couldn't
care less I shouldn't have to suffer their illegal? practice nor be
out of pocket as a result.

Yours faithfully,

Julie Shrive

Dear Ivan Pocock,
Freedom of Information Request P0005355

Is your letter below correct? T he fact had to download makes me
smell a rat ? Yet again we have a Call Centre public employee
wasting public time and money trying to play dumb - being totally
unhelpful and unconstructive because directed by an accountant . He
knows not legal & his Dept has no responsibility so is just
pretending problem not happening surely not helpful, economical or
erhical - taking the money and running like their bosses?

Dear Julie Shrive,

I am writing regarding your request for information, which I
received on 28th May 2009. In that request, you asked us for:

“Is it legal for a skip lorry to block the road so one can't turn
round? My disabled Kangoo van/car carrying disabled scooter has had
its rear windscreen wiper knocked off by a lampost painted black
[camouflaged] because road so narrow. Why do police not want to
know say civil and firm Brewers couldn't care less I shouldn't have
to suffer their illegal? practice nor be out of pocket as a
result.”

I will be unable to proceed with your request without clarification
of the information you wish to receive. Can you please confirm
exactly what information you are requesting from us as a Central
Government Department under the Freedom of Information Act 2000. I
must advise that we are unlikely to hold information on the
legality of a skip lorry blocking a local road.

Please note that if I do not receive appropriate clarification of
your information requirements within three months from the date of
this letter, then I will consider your request closed.

If you wish to discuss any of the above, please contact me. Please
remember to quote the reference number above in any future
communications.

Yours sincerely,

Julie Shrive

NB.
I am Dyspraxic [ location] at MA level better orally than written down - most can't drive .These public and private Call Centres totally disregard special needs . Then blame to keep their noses clean. Should they write down your problem it will be totally misinterpreted because of academic ability and remits.Did not have a problems before there were call centres & PAs on remits .Could resolve/sort out often in 10min flat . Then there were Manager's and Leaders with authority, ethics and discretion. Now there are none or bought in p/t on contract like the lawyers and doctors . Does this reply above help. God help the elderly & those with dementia you will be left to sink.??!!!

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Department for
Transport's handling of my FOI request 'RIGHT OF WAY ?'.Shouldn't
the Dept of Transport and Police know or have access to the rules
of the road and be seeing they are complied with not pick and
choose hiding their disgraceful time wasting waffle at the expense
of the tax payer .
If a citizen is being sent from pillar to post why are they not
given the named person with responsibility for it who resolves ,or
is there noone as i suspect. It make those with supposed authority
look stupid when operate in call centres without discretion.

A full history of my FOI request and all correspondence is
available on the Internet at this address:

Why are there people working for Dept of Transport do not Know or cannot access the law . They continually want clarification, even when given it don't understand because programmed not to ,by remitsand procedures .
Are they so befuddled they don't know what is decent behaviour/work with integrity .If you become upset at this winding up they blame and maligne using data protection to do so .

Are we being punished and ripped off by them?

Dear Ivan Pocock,

I have become phobic at opening your secretive waste of time
downloads which do not resolve. What is your position, because I
don't feel assisted and that you are using my Dyspraxia to befuddle
and confuse .

This is not straightforward .I am giving up as you are playing
games and I might endure another cardiac. But that is what you want
isn't it???!!!!

Yours sincerely,

Julie Shrive

No where in this correspondence has the department refused to answer your query, what they have done as they are entitled to under the Freedom of Information Act is to ask you for clarification. As with many of your request you are unclear on what you are actually requesting. Civil servants are not mind readers.

You also seem to have a problem with responses which you believe come from call centres, When in reality they are centralised correspondence units. How else do you think that letters to departments should be answered, randomly by the first person who opens your letter.

Who is the G. White, a complete waste of time, probably Manager of the Call Centre who uses clarification because they do not have the remit to resolve.
As I am dyspraxic, I am even more confused !Even if clarified problems these people [biased in gender handling ] deliberately misinterpret, wind up then maligne/libel so don't have to adress as have no discretion in our lovely democracy. They are acting illegally as NO DUTY OF CARE.
