Dear Sir or Madam,

I wish to know details concerning consultation.

As you may know that in the Local Authorities' Traffic Orders
(Procedure) (England and Wales) Regulations 1996 it states under
the Heading 'Consultation' Section 7 of table, Section (c) says
“Such other organisations (if any) representing persons likely to
be affected by any provision in the order as the order making
authority thinks it appropriate to consult.”

Please can you tell me which of the following groups and/or
stake-holders have been consulted about the revised motorcycle
traffic order during the three week consultation period ending on
the 3rd July 2009.

1) Residents associations, please provide a full list of those
which were consulted about the revised motorcycle parking orders
during the three week consultation period ending on the 3rd July
2009?

2) Please provide a full list of those residents associations which
responded in favour of the revised orders being made permanent?

3) Motor Cycle Action Group?

4) British Motorcycle Federation?

5) No To Bike parking Taxes campaign committee?

6) Association of British Drivers?

7) The Tax Payers Alliance?

8) Drivers Alliance?

9) Of groups listed in question 3 to 8, please state which groups
responded (if asked) in favour of the revised motorcycle parking
orders being made permanent?

10) Please provide a list of all other stake-holders which have
been directly approached by Westminster City Council as part of the
consultation for the revised motorcycle parking orders during the
three week consultation period ending on the 3rd July 2009 ?

Dear MotorCycleParking,

I'm sorry but your reply did not contain the information requested.

There was no attached spread sheet.

Just to be clear, I am asking about a very specific consultation
period with is for the three weeks commencing on the 12th June 2009
until the end of Mr Chalkleys consultation period, the 3rd July
2009. So I only require details of, for example those residents
associations which were consulted and responded to your
consultation within that three week period. The same time-scale
applies to any other stake holder group you have consulted.

Rather bizarrely you have pointed out that “only objections for
this order are captured and recorded “, so please can you tell me
why you would only record objections for what is being called a
consultation period?

Dear MotorCycleParking,

Thank for your answer, however I do need to check a point with your
reply. You list the British Motorcycle Federation as having been
consulted between the 12th June 2009 and the 3rd July 2009
regarding the tax on motorcycles and scooters to park in
Westminster.

However I have since checked with the British Motorcycle Federation
who do not believe you have contacted them. Would you please double
check that the information you have supplied me is correct?

As I am asking you to verify the information you've already
supplied so I'm not changing the scope of the inquiry I would
expect an immediate response, thank you.

Information reviews.

I am writing to request an internal review of Westminster City
Council's handling of my FOI request 'Revised motorcycle traffic
order stake-holder consultation'.

My reasons for requesting an internal review are:-

1) Information supplied late

2) Information supplied is inaccurate, as the BMF are listed as
having been consulted, they were not.

I've also had a reply from the St Marylebone Society, who say this:

the society had a committee meeting on Monday (5th), as far as the
members present were aware the society was not consulted about the
motor cycle parking.

It is not good enough in my opinion to provide a link to their own website as proof that they contacted the BMF. May I suggest you ask for a copy of the correspondence that was sent to the BMF at the time as proof of consultation. That way, you will be able to check with the BMF contact that they had indeed received the letter/email and have a copy of any response they might have sent back to the council. Dig in!
