RESPONSIBILITY FOR COURT COMPUTER RECORDS

Dear Sir or Madam,

WITH REGARD TO SECTION 12 (1) OF THE COUNTY COURT ACT 1984:

Records of proceedings to be kept by district judges

(1) The district judge for every district shall keep or cause to be
kept such records of and in relation to proceedings in the court
for that district as the Lord Chancellor may by regulations made by
statutory instrument prescribe.

WILL YOU CONFIRM OR DENY THE COURT COMPUTER RECORDS FALL UNDER THE
JURISDICTION OF THE DISTRICT JUDGE.

Dear Sir or Madam,

I HAVE RECEIVED THE FOLLOWING LETTER FROM MERSEYSIDE POLICE DATED
FEBRUARY 24TH 2009 POSTED ON THE 4TH OF MARCH 2009.

"With regard to Incident Log Number Log Number ALTARIS 0901260417
(Report of Fraud)

Since this incident was reported we have made several attempts to
contact you to discuss the matter and obtain a written statement of
complaint. Regrettably we have been unable to obtain an official
complaint from you.

If you have been a victim of crime it is important, in order to
comply with the Home Office & National Crime Recording Standards,
that you make an official complaint. If there is sufficient
evidence that a crime has been committed the police will ‘crime’
the incident and commence an investigation. It may transpire upon
speaking to an officer that there is insufficient evidence to
‘crime’ the incident.

The incident log has now been closed and no further police action
will be taken.

However if you do still wish to discuss this incident with the
police, please contact the Customer Services Desk on the above
number quoting the log incident number and the log will be reopened
and any necessary action will be taken."

CLEARLY THE POLICE WILL NEED TO KNOW THE LIVERPOOL COURTS VERSION
OF WHY THE COURT COMPUTER WAS ALTERED AND, GIVEN THE RESPONSIBILITY
OF THAT ALTERATION RESTS WITH HMCS, I WILL BE UNABLE TO AID A
POLICE INVESTIGATION UNTIL HMCS CONFIRMS OR DENIES THE COURT
COMPUTER FALLS UNDER THE JURISDICTION OF A DISTRICT JUDGE.

I WILL WRITE TO THE CHIEF CONSTABLE AND REQUEST MERSEYSIDE POLICE
TO REOPEN THEIR LOG AND, PENDING INFORMATION FROM HMCS AS TO WHO IS
RESPONSIBLE FOR ENTRIES ON THE COURT COMPUTER AND WHICH OF THE TWO
VERSIONS HELD BY THE POLICE ARE VALID, WILL ARRANGE AN APPOINTMENT
FOR DISCUSSION OF THE EVIDENCE AND ITS EFFECT ON MYSELF.
