Responses sent to EU commission in regards to Phorm

P Seurre made this Freedom of Information request to Department for Business, Enterprise and Regulatory Reform

The request was refused by Department for Business, Enterprise and Regulatory Reform.

From: P Seurre

15 April 2009

Dear Sir or Madam,

I refer you to my previous FoI request:

http://www.whatdotheyknow.com/request/re...

At the time this was rejected because it was apparently not in the
public interest to do so at the time.

We are now being sued by the EU commission thanks to the apparent
failure of this government to properly implement EU legislation.

We now have the possibility of large fines that will have to be
paid by UK taxpayers combined with the apparent ineptitude show by
the UK government in it's dealings with the confidentiality of
data. As a result of this I believe that the situation has now
sufficiently changed to merit the release of these undisclosed
documents.

Please could you provide the documents that were requested in my
previous FoI request.

Yours faithfully,

Patrick Seurre

Dear Balchin Patrick (BR2),

I believe that you're referring to this?:

'Section 27 (1) (b) exempts information if its disclosure would, or
would be likely to prejudice, relations between the United Kingdom
and any international organisation. This would include, for
example, the European Commission.'

Please could you explain how exactly the release of such
information would prejudice relations between the United Kingdom
and the EU commission?

The commission has been very open about the matter, even up to and
including publishing the full letter sent to the UK government. I
fail to understand the damage that would be done and personally see
this as nothing more than an attempt to unreasonably block the
release of the documents.

Yours sincerely,

Patrick Seurre
