17 July 2009

Dear Sir or Madam,
I herewith wish to state that I received the following message on
16/july/2009 and it has lot of discrepencies and it is totally
different decision to which I received on 31/03/2009 from your
office.
Fco stated on 31/03/2009 that my passport application was refused
due to ineligible. But now on 16/july/2009 it was stated that I
didn't provide sufficient documents.

I request you to please disclose, reveal the exact documents what I
was not submitted as per your view although I submitted all
documents required by BHC,Malaysia.it was confirmed by your staff
Mr.L.Noel on 08/01/2009 and he confirmed it.So I expect from you to
explain everything to disclose.

Dear Mr Faghurudeen

Thank you for your e-mails of 16 July about your application for a
British Overseas Citizen (BOC) passport.

We have reviewed your case but unfortunately there is nothing
substantive I can add to any of the previous responses you have
received from the FCO or our High Commissions in Chennai and Kuala
Lumpur.

I understand that UKBA have explained that based on the information
you provided to them they could state you are eligible for a BOC
passport. However, this information can only be used in conjunction
with satisfactory evidence to support any claim. It is for the
office processing your passport application to be satisfied that
the documents you provide in support of your application prove
conclusively your identity and your link to the father through whom
you are claiming British citizenship. As has been explained to you
several times, the documents as well as the answers you provided at
interview have not been sufficient to provide this satisfaction.
Your most recent passport application was also refused on this
basis.

In the likelihood that it may not be possible for you to provide
any further (original) documentary evidence, it has been suggested
that you might want to consider DNA testing to confirm the link
between you and your father. I appreciate that this may be an
expensive option for you but the onus is on the applicant to prove
their claim to British citizenship. British Nationality is a matter
of law, enacted by Parliament and we do not have the discretion to
vary its provisions in individual cases. British Passports can only
be held by those who are eligible.

I am sorry to send you a disappointing reply but as has been
explained before we can not issue a British passport when we are
not entirely satisfied as to the citizenship status of the
applicant.

As advised in Emily Summers' e-mail to you of 11 July 2008 we will
not enter into any further correspondence on this issue unless you
are able to provide further substantial evidence to prove your
claim.

Yours sincerely

Sarah Ballett

Dear Mr Faghurudeen,
Thank you for your e-mail enquiry of 05 March about your
application for a UK passport at the British Embassy in Kuala
Lumpar, Malaysia.
Your letter has been forwarded to Passport Policy and Procedures
Section for reply, as we have responsibility, within the Consular
Directorate of the Foreign & Commonwealth Office, for Passport
matters overseas.
I contacted our Vice Consul in Kuala Lumpur requesting that he
investigate the matters you have raised, and am now in a position
to issue a response. I understand that you were interviewed on 28
January, and that your application for a British Overseas Citizen
passport was refused in accordance with Section 26 of the British
Nationality Act 1981.
When determining a person's claim to British nationality we
consider the place of birth, the legislation in force at the time
as well as any ancestral links to the United Kingdom. On the basis
of the information provided, unfortunately, you have no claim to
British nationality.
Yours sincerely,
