provide you with the following information with regard to your
request: In addition to the on-line consultation on the Ordnance

three additional responses have been received to date. Of these
responses, one received from the Advisory Panel on Public Sector
Information (APPSI) has been published on their web site at:

Please be aware that not all of the relevant information Ordnance
Survey holds has been provided with this response, as parts of it
fall within the Information provided in confidence exemption under
section 41 (1) of the Freedom of Information Act 2000 (FOIA). We
believe this exemption applies because some information provided by
other parties was given under a duty of confidence that Ordnance
Survey would not release the information if requested. Therefore we
will not be releasing this information to you.

As section 41 (1) applies to this case, which is an Absolute
exemption, the Public interest consideration (section 17 FOIA) it
is not applicable in this instance.

Please note that your enquiry has been processed to Freedom of
Information guidelines. If you are unhappy with our response, you
may raise an appeal to our Appeals Officer at: Complaints Team

Thankyou for your response to my initial Freedom of Information request 71174.

You have claimed exemption under section 41 (1) of the FOI act, which states:

(b) the disclosure of the information to the public (otherwise than under this Act) by the public authority holding it would constitute a breach of confidence actionable by that or any other person.

However, you have offered no evidence that the original request for responses to the Business Consultation were made in confidence. Therefore, I now request the original emails or letters from the Ordnance Survey to the two public bodies who have not been named here. If you cannot provide evidence that the responses were solicited in confidence, then I request that their responses be published.
