This is a request for information as to what Kent Police's plan is
to destroy DNA and fingerprint data in light of the recent European
Court of Human Rights Judgment.

Mr Maccariello,
Thank you for your interest in this matter. There is in fact no
information held by Kent Police that meets the requirement of your
request. No plans exist at present to destroy DNA and other
information following the Marper and S case judgement of 4 December
2008. However the following statement may be of interest.
The Home Secretary announced a public consultation exercise into
her proposals for changing the law on collection, retention and
deletion of DNA and fingerprints from the national DNA database.
The current law has not changed. Further information regarding the
announcement can be found at the Home Office website at
www.homeoffice.gov.uk/documents/cons-200....
Kent Police's current position when dealing with requests for the
deletion of PNC records and the destruction of fingerprint and DNA
samples of unconvicted people remains the same. Only in exceptional
cases will the Assistance Chief Constable consider destruction.
