Dear Stockport Borough Council,

The Leader of Stockport Council a released confidential court
document to me regarding a third party. I have questioned this
action but received no response. Please may I see any documents
held by the Council with regards to this breach of the Data
Protection Act and my subsequent objection to this action.

Dear Mrs Oliver,

I am writing in response to your request for information below (ref 2618).

Contrary to your comments below, you corresponded with the Council
regarding the matter you refer to and received a response on 27^th July
2009 which outlined the Council's position in relation to your concerns
that a contravention of the Data Protection Act 1998 (DPA) had occurred.

Regarding your request below, the Council does not consider that a breach
of the DPA has occurred; therefore no information is held in relation to
your request.

If you are unhappy with the way we have handled your request you are
entitled to ask for an internal review. Any internal review will be
carried out by a senior member of staff who was not involved with your
original request. To ask for an internal review, contact

If you are unhappy with the outcome of any internal review, you are

Dear Stockport Borough Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Stockport Borough
Council's handling of my FOI request 'Release of confidential court
document'.

How on Earth can release of a confidential court document, which I
assume the Leader of the Council, Councillor Goddard, shouldn't
have had access to anyway, not be a breach of the Data Protection
Act?

Dear Mrs Oliver,

I am writing in response to your email below (ref 2618).

As I have previously explained, your enquiry regarding this matter has
been dealt with in 2009. The Council does not consider that a
contravention of the Data Protection Act 1998 (DPA) occurred. With this in
mind, please clarify exactly what you are referring to in your request for
an internal review - the purpose of the internal review process under the
FOI Act is not to enable you to challenge the Council's view as to whether
or not it has contravened the DPA in carrying out previous, unrelated
actions.

Dear FOI Officer,

I do not understand your reply. How has this issue been dealt with?
Councillor Goddard sent me a confidential Crown Prosecution Service
document about someone sent to prison. Crown Prosecution documents
are never released to the public, so the very fact that he had it
indicates problems with the Data Protection Act. The fact that he
then sent it to me, apparently gloating because a sick (and we now
know innocent) man had been sent to prison is therefore doubly
troubling.

We need to know what has gone on here. I would accept an
explanation from the Monitoring Officer in writing if you consider
this is not a FOIA issue, but Stockport Council itself has made
every single issue I contact them about a FOIA request. That was
their decision and not mine. I look forward to hearing from you or
Ms Alison Morrissey, whom I assume to be the Monitoring Officer at
Stockport. Obviously, such a breach of Data Protection raises
serious issues. The gentleman in question had most certainly
suffered enough at the hands of Stockport Council without adding
this further insult.
