Dear Sir or Madam,

Please Can You let me Know Are Residents in the Birmingham Area
Allowed to Leave there Refuse Bins on the Public Footpath Outside
There Homes 7 Days in the Week ?
Or Only Allowed Put them Out on Refuse Collection Day ?

If Residents on Some Streets Do Leave there Refuse Bins 7 Days In
Weeks Does or can the Birmingham Council Take Steps to Proscute
Residents or Do You Just Write to Residents Concerned ?

As Refuse Bins Left on Highways can Cause Obstruction for Prams,
Mobilty Scooter, Blind Persons, and Bins Make Street Look Untidy ,
But in the Hot Weather Rubbish Smells on the Streets where Bins
Area Left on Highways [ Footpath ]

I am writing in respect of your recent enquiry for information held by the
Authority under the provisions of the Freedom of Information Act 2000.

Please find below the following answers to your request:

* Please Can You let me Know Are Residents in the Birmingham Area

Answer:
We do not use refuse bins in our area - we just have sack collections
We ask residents not to put out their bags more than the day before
collection

* If Residents on Some Streets Do Leave there Refuse Bins 7 Days In

Residents or Do You Just Write to Residents Concerned ?

Answer:

It is illegal to leave refuse out for collection prior to the day it is
scheduled for collection. If we are aware it is occurring then
a warning letter will be sent to the occupier of the property. If they
still continue to leave refuse out early, then we will serve
a notice on them requiring them to put refuse out on the correct day. If
they still continue to leave the refuse out then we will
prosecute. The legislation concerned is section 46
Environmental Protection Act 1990.

If you are not satisfied with the response please contact me in the first
instance in order that I may assist, if you are then still not satisfied
you may ask for an internal review.
