Thank you for your enquiry which has been logged under the above reference. Having completed my enquiries I am able to respond as follows:
Please could you provide me with a copy of the information you have been asked to disclose as a result of the Information Commissioner's decision [Reference: FS50222048] in relation to a speed camera on the M11
A copy of our latest reply is as follows and I hope is of use:
"Freedom of Information Request: Case Reference Number FS50222048
I refer to your previous exchanges of correspondence with this unit regarding your original request for information, subsequent request for review of the Essex Police response and finally to the intervention of the Information Commissioner's Office.
You will be aware of the Decision Notice issued by the Information Commissioner against the Chief Constable of Essex Police dated 8th September 2009. The Notice required, at paragraph 42, that Essex Police take the following steps:
Steps Required
42. The Commissioner requires the public authority to take the following steps to ensure compliance with the Act:
* Disclose to the complainant the annual totals of penalty charge notices issued for the years 2003, 2004, 2005, 2006, and 2007 and the totals for the periods October to December 2002 and January to May 2008.
43. The public authority must take the steps required by this notice within 35 calendar days of the notice.
Accordingly please find below the statistics referred to in the Notice for the safety camera in question:
8 Oct 2002 to 31 Dec 2002 - 3007
2003 - 9639
2004 - 8451
2005 - 9047
2006 - 7801
2007 - 3305
1 Jan 2008 to 1st May 2008 - 562
I would ask you to note that these statistics have now been provided to you on the basis that the data is now historic in nature. Should similar requests be received by Essex Police in the future they will be assessed on a case by case basis; taking into account the specific circumstances of each, and giving consideration to factors such as site location. It should not be inferred that the Decision Notice issued by the Information Commissioner means that such data will be automatically disclosed.
